The Public Procurement Procedure Is Conducted In The Form Of An Open Tender, Pursuant To Art. 132 Of The Act Of September 11, 2019 - Public Procurement Law (Journal Of Laws Of 2026, Item 793, As Amended) - Hereinafter Referred To As The Act. 2. The Ordering Party Informs That In Accordance With Art. 139 Section 1 Of The Act, It Will First Examine And Evaluate The Offers, And Then Subjectively Qualify The Contractor Whose Offer Was Rated The Highest In Terms Of The Lack Of Grounds For Exclusion And Meeting The Conditions For Participation In The Proceedings. 3. The Subject Of The Order Is The Supply Of Server And Network Equipment Along With Implementation. 4. A Detailed Description Of The Subject Of The Contract (Hereinafter: Opz) Together With The Draft Provisions Of The Public Procurement Contract That Will Be Introduced Into The Public Procurement Contract (Hereinafter: Drafted Provisions Of The Contract) Constitute Annexes No. 1 And 2 To The Swz. 5. The Ordering Party Does Not Allow The Submission Of Variant Offers, Does Not Intend To Conclude A Framework Agreement, Does Not Provide For The Selection Of The Most Advantageous Offer Using An Electronic Auction, And Does Not Require The Submission Of An Offer In The Form Of Electronic Catalogs Or The Attachment Of Electronic Catalogs To The Offer. 6. The Ordering Party Does Not Envisage Awarding Contracts Referred To In Art. 214 Section 1 Point 7 And 8 Of The Act. 7. Whenever In The Swz And Its Annexes, The Ordering Party Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, In Accordance With Art. 101 Section 4 Of The Act, The Ordering Party Allows Solutions Equivalent To Those Described. If The Order Documents Indicate A Brand, Trademark, Patent Or Origin That Characterizes The Products Or Services Provided By Specific Contractors, These Indications Should Be Treated As Defining The Desired Standard And Quality. The Ordering Party, Pursuant To Art. 99 Section 5 Of The Public Procurement Law, Allows The Offer Of Equivalent Products Or Services, I.E. Those Guaranteeing Parameters And Functionalities Not Worse Than Those Assumed In The Order Documents. If An Equivalent Solution Is Offered, The Contractor Is Obliged To Demonstrate The Equivalence Of The Solutions Used Together With The Offer. 8. The Ordering Party Pursuant To Art. 462 Section 2 Of The Act Requires The Contractor To Indicate In The Offer The Parts Of The Order The Performance Of Which He Intends To Entrust To Subcontractors And To Provide The Companies (Names) Of Possible Subcontractors, If They Are Already Known. 9. The Ordering Party Does Not Divide The Order Into Parts Due To Its Nature, Scope And The Need To Ensure Technical And Organizational Coherence Of The Implemented Project. The Subject Of The Order Includes The Delivery Of It Devices And Their Implementation, Which Constitute A Functionally And Technologically Related Whole. Individual Elements Of The Order Are Closely Correlated And Require A Uniform Design And Implementation Approach. Dividing The Contract Into Lots Could Result In The Need To Coordinate The Activities Of Several Contractors, Which Would Increase The Risk Of Irregularities
