The Subject Of The Order Is: Part 1. Construction Of A Parking Bay Along The District Road No. 1467 T Ruda Białaczowska - Gowarczów At Km 4+165 - 4+317 In The Town Of Gowarczów. The Works Will Be Carried Out Without Interrupting Local Traffic - With Half Of The Road Closed To Traffic Or With The Complete Closure Of The Road Section, Taking Into Account The Conditions For Carrying Out Works In The Road Zone Specified In Annex No. 1 To The Swz. 2.4 The Ordering Party Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing The Indicated Activities In The Scope Of The Execution Of The Order, Consisting In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2025, Item 277, As Amended). The Above Requirement Does Not Apply To The Construction/Works Manager, Because In Accordance With Art. 12 Of The Construction Law, Activities Involving The Management Of Construction Or Other Construction Works May Be Performed By A Person Performing An Independent Technical Function In Construction. Only People With Construction Qualifications Can Perform An Independent Technical Function In Construction. Construction Licenses Are Granted Individually. Therefore, In Order To Manage Construction Works, It Is Not Necessary To Establish An Employment Relationship Under The Employers Supervision.
