Repair And Maintenance Services Of Rolling Stock – Performance Of P4 Maintenance Level Maintenance Services For Bogies Type 19Mn And 32An (Sa105) Along With Additional Works. 1. The Subject Of The Order Is The Provision Of Services Including The Performance Of The Following Works (Hereinafter Referred To As The Subject Of The Order): A) Activities Of The Fourth Level Of Maintenance (P4) As Part Of 1 (One) Technical Service For Bogies Of The Sa105 (213M) Vehicle With Factory Number 001 (Hereinafter Referred To As Pcs Or Vehicle), And For 1 (One) Technical Service There Is A Set Of Bogies On The Vehicle, I.E.: 1 (One) 19Mn Drive Trolley And 1 (One) 32An Rolling Trolley (Hereinafter Referred To As The Trolleys) (Hereinafter All Activities Listed In This Letter Are Referred To As The Basic Tasks); B) Subject To Section 2 Optional Works Related To The Performance Of Activities Of The Fourth Level Of P4 Maintenance Of Bogies, Going Beyond The Scope Of Work Provided For In Point A. (Hereinafter The Above Optional Works Referred To As Optional Tasks) C) Subject To Section 2, Other Works That Do Not Constitute Basic Tasks Or Optional Tasks Necessary To Restore The Proper Functioning Of The Trolleys Or To Meet The Requirement Referred To In §6 Section 1 Of The Contract Template (Hereinafter Referred To As Unplanned Tasks). The Ordering Party, Together With The Trolleys, Will Provide The Contractor With The Materials/Parts/Components Indicated In Annex No. 8 To The Contract Template (Appendix No. 4 To The Swz). The Contractor Is Obliged To Arrange The Remaining Parts, Materials, Components And Standards Necessary To Perform The Subject Of The Order At His Own Expense And Risk. A Detailed Description Of The Subject Of The Order, Type And Conditions Of Service Are Specified In Annex. No. 4 To Swz. 2. The Ordering Party Reserves The Right To Unilaterally Order The Implementation Of The Subject Of The Order To The Extent Including Optional Tasks And Unplanned Tasks (Hereinafter Referred To As The Additional Tasks Option). The Ordering Partys Use Of The Additional Tasks Option Obliges The Contractor To Complete The Subject Of The Order Also To The Extent Indicated By The Ordering Party. 3. The Ordering Party Is Entitled To Use The Additional Tasks Option When Restoring A Given Truck To Full Functionality Requires The Implementation Of Optional Tasks Or Unplanned Tasks, Respectively. The Ordering Party Is Entitled To Use The Additional Tasks Option In Whole Or In Part According To Its Needs. The Contractor Is Not Entitled To Any Claims Against The Ordering Party Due To The Ordering Partys Failure To Use The Additional Tasks Option. 4. The Handover And Collection Of The Trolleys Will Take Place At The Ordering Partys Rolling Stock Maintenance Point, I.E. Put Poznań, Ul. Kolejowa 23, 60-717 Poznań. 5. The Contractor Is Obliged To Complete The Subject Of The Order With Due Diligence In Accordance With The Vehicle Maintenance System Documentation And The Vehicle Maintenance And Operational Documentation. 6. In All Provisions Of The Contract Notice, Swz And Its Annexes, In Which The Ordering Party Describes The Subject Of The Order By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, It Should Be Considered That The Ordering Party Allows The Product
