Servers – Industrial Server Framework Agreement Including Roll-Out And Roll-In Services. The Subject Of The Framework Agreement Is The Procurement Of Robust, Standardized And Standard Industrial Servers With A Hardware Guarantee Including On-Site Support As Well As The Roll-Out Service And Roll-In Service For These Servers At The Offices Of The State Of Baden-Württemberg And, In Special Cases, At Other Locations In Germany. Servers Are Procured In Three Performance Classes: Server Hardware Standard, Server Hardware Performance (Version 1U) And Server Hardware Performance (Version 2U). In The First Week After The Contract Was Awarded, 3 X Server Performance (Including 1 X 1U And 2 X 2U), 2 X Server Standard And 2 X Server Portable With The Associated Network Cards Must Be Delivered In Preparation For The Pilot Installation. Delivery Must Take Place No Later Than The Tenth Working Day After The Contract Has Been Awarded. The Services Are Accessed Based On Needs; A Specific Period Cannot Be Specified. There Is No Entitlement To Acceptance Of The Service. The Contract Term Begins When The Contract Is Awarded And, Unless Previously Terminated, Is Initially Two Years (Minimum Contract Term). The Client Reserves The Right To Extend The Contract Twice By 12 Months Each Time (Optional Contract Periods). The Minimum Contract Term Is Automatically Extended By Another Year Unless The Client Terminates The Contract Three Months Before The End Of The Contract Term. The Same Applies To The Other Optional Extensions. The Estimated Quantities Can Be Found On The Price Sheet. These Reflect The Expected Purchase Quantities. During The Term Of The Contract, The Client Can Access Additional Servers (Up To Twice The Value Of The Estimated Purchase Quantity) Including Services Beyond The Requirements Of The Estimated Purchase Quantity. There Is No Legal Right To Accept The Estimated Order Volume. A Minimum Purchase Is Not Agreed. The Contract Ends In Any Case When The Maximum Total Order Limit Of Eur 2,300,000.00 Net Is Reached; Eur 2,737,000.00 Gross (Including Optional Services). If The Order Value Is Increased Due To An Order Change During The Contract Term In Accordance With Section 132 Gwb, The Contract Ends When This New Order Value Is Reached. The End Of The Contract Does Not Affect The Contractors Obligation To Provide Services In Accordance With The Contract For Orders Placed During The Contract Period.
