1. The Subject Of The Order Is The Reconstruction Of The Road At Czerwonego Krzyża Street, On The Section Adjacent To Ul. Piastowska To The Left-Hand Entrance To Plot No. 649/10, Administratively Located In Żary. 2. The Scope Of The Order Includes: 1) Milling Of The Existing Surface; 2) Regulation Of Existing Valves And Wells Of External Devices; 3) Construction Of A New Wearing Course Of The Road; 4) Hardening Of The Bus Stop Platform With Concrete Paving Stones; 5) Construction Of A Parking Lot With 10 Parking Spaces; 6) Reconstruction Of Existing Exits; 7) Adjustment Of Existing Curbs. The Total Length Of The Investment Project Is 485.36 M3. A Detailed Description Of The Subject Of The Order Is Presented In The Following Documents Attached To This Swz, I.E.: 1) Land Development Design; 2) Technical Specifications For The Execution And Acceptance Of Construction Works (Stwiorb); 3) Bill Of Quantities. Due To The Fact That The Contractors Remuneration Indicated In The Offer Will Be A Lump Sum, When Pricing The Offer, The Contractor Should Rely On The Scope Indicated In The Documentation Referred To In Point 3 Above. The Bill Of Quantities Is Of An Auxiliary Nature. The Occurrence, During The Execution Of The Contract, Of Works Not Included In The Bill Of Quantities Or Of Works In A Larger Quantity Than That Accepted In The Bill Of Quantities Will Not Entitle The Contractor To Demand Additional Remuneration - If These Works Were Included In The Documentation Referred To In Point 3. If The Content Of The Documentation Contains Any Provisions Regarding The Conditions For The Implementation Of The Subject Of The Order, E.G. Rules For The Introduction Of Additional Or Replacement Works, Acceptance Of Works, Method Of Settlement, Which Are Not Reflected In The Content Of This Tor And The Draft Contract Or Are Inconsistent With Them, The Provisions Of The Swz And The Draft Agreement Constituting An Annex To The Swz Should Be Accepted As Binding.4. The Offered Construction Works Must Meet The Requirements Of The Ordering Party, Described In The Above-Mentioned. Documentation, In Accordance With All Applicable Legal Acts Applicable To The Subject Of The Order, And Under The Terms And Conditions Contained In The Contract.5. Justification For Not Dividing The Order Into Parts: The Value Of The Order Is Lower Than The So-Called Eu Thresholds That Oblige To Implement Eu Directives. Directive 2014/24/Eu States In Recital 78 That, In Order To Increase Competition, Contracting Authorities Should In Particular Be Encouraged To Divide Large Contracts Into Lots. The Contract In Question Is Not A Large Contract Within The Meaning Of Recital 78 Of The Above-Mentioned Eu Directive (The Directives Apply From The So-Called Eu Thresholds, And The Directive Uses The Concept Of A Large Contract In The Context Of Contracts Subject To The Directive, I.E. A Contract With A Value Significantly Exceeding The So-Called Eu Thresholds). The Order Was Not Divided Into Parts For Th
