Which Tender Amount To Be Subjected To A Reduction, Relating To Continuous Services; - 565,000.00 Euros Net Of Vat Not To Be Subjected To A Reduction, For Specialist Professional Services On Request Divided Into (I) 315,000 Euros For Fees Relating To The Services Referred To In The Ministerial Decree. 194/2024; (Ii) 250,000 Euros As Reimbursement Of The Sums Advanced By The Assignee For Duties, Taxes, Stamp Duty As Well As For The Remuneration Of Foreign Correspondents. The Overall Amount For The On Request Specialist Services Represents A Non-Binding Maximum Expenditure Ceiling For Rai, Up To Which Contractual Services Can Be Activated Exclusively On The Basis Of Actual Business Needs And Upon Specific Request From Rai. The Related Economic Valorisation Will Take Place By Applying The Unit Fees Indicated In The Table Attached To The Technical Specifications Or, For Services Not Included In The Same Table, The Hourly Rate Of €200.00/Hour. - With Reference To The Main Services, Pursuant To Art. 119 Paragraph 2 Of The Code, Subcontracting Is Not Authorized, Including The So-Called Cascade Subcontracting Pursuant To Art. 119, Paragraph 17, Of Legislative Decree No. 36/2023, Given That The Services Covered By The Assignment Involve The Development, Processing And Management Of Rais Strategic Intangible Assets, As Well As Access To Confidential Information And Distinctive Signs, Even Those Not Yet Registered, Subjected To Conception And Design Processes. The Direct Execution Of The Activities By The Successful Tenderer Is Deemed Necessary In Order To Preserve Confidentiality, Commercial Secrecy, The Integrity Of Company Information And Unitary Control Of The Entire Creative And Design Process. The Use Of Subcontracting Would In Fact Lead To An Extension Of The Circulation Of Confidential Information To Further Economic Operators, With A Consequent Increase In The Risks Of Unauthorized Dissemination, Compromise Of Company Know-How And Prejudice To The Protection Of Rais Intangible Assets. It Is Understood That Merely Accessory And Instrumental Activities Necessary For The Fulfillment Of Obligations With Foreign Authorities And Regulations, Which Do Not Involve The Execution Of The Main Services Covered By The Assignment, May Be Entrusted Through Subcontracts, Within The Limits And In The Manner Permitted By Current Legislation, Without Prejudice To The Full Responsibility Of The Contractor Towards Rai.
