1. The Subject Of The Order Is The Implementation Of The Investment Task Entitled: Modernization Of The Village Community Center In Chyżyny, Latowicz Commune. The Scope Of Work Includes Construction And Assembly Works Based On The Attached Bill Of Quantities And Description Of The Works. The Tender Does Not Cover The Implementation Of The Scope Of The Bill Of Quantities In Item 6, 7, 8,11, 21, 29, And From Pos. 43 To Pos. 57. The Contractor, On Behalf Of And For The Benefit Of The Ordering Party, Will Complete The Task In Accordance With The Applicable Construction Law Provisions. The Ordering Party Obliges The Contractor To Take Into Account The Requirements Regarding Accessibility For Disabled People At The Facility After Its Completion For All Users, In Accordance With Art. 100 Paragraph 1 Of The Act2. The Removal Of Rubble And Other Dismantled Materials From The Construction Site Will Be Carried Out By The Ordering Party On Its Own, In Accordance With The Provisions Of The Waste Act.3. The Ordering Party Allows The Contractor To Use Solutions Equivalent To Those Described At The Stage Of Submitting The Offer And When Implementing The Task. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate In The Offer That The Supplies, Services Or Construction Works Offered By Him Meet The Requirements Specified By The Ordering Party. 4. The Ordering Party Informs That It Allows The Submission Of Equivalent Offers, I.E. Offers In Which Individual Devices Or Materials Listed In The Design Documentation And Bill Of Quantities Will Be Replaced By Equivalent Devices Or Materials, I.E. Those Whose Technical And Operational Parameters Correspond To Or Exceed The Parameters Of The Devices Or Materials Indicated In The Description Of The Subject Of The Order.5. Any Indicated Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes Products Or Services Provided By A Specific Contractor Indicating The Manufacturer Or Origin Only Determine The Class Of The Product, Materials Or Devices, Technology Systems, Etc. And Are Only Exemplary Names Resulting From The Specificity Of The Subject Of The Order, And Such Indication Is Accompanied By The Words Or Equivalent And Are Not Binding On The Contractors. In The Offer, The Contractor May Accept Materials And Devices, Systems And Technologies From Other Manufacturers With Technical Parameters, Quality And Functional Properties Corresponding To Those Described. 6. The Contractor Will Be Obliged To Perform Construction Works In Accordance With Polish Law, In Particular With Technical And Construction Regulations, Regulations Regarding Independent Technical Functions In Construction And Regulations Regarding Products And Materials Used In Construction, In Particular: - The Act Of July 7, 1994, Construction Law (Journal Of Laws Of 2024, Item 725, As Amended), 7 Appropriate Professional Qualifications To Perform The Full Scope Of The Subject Of The
