The Subject Of The Order Is The Purchase And Delivery Of A New Multifunctional Telescopic Loader With Accessories In Accordance With The Requirements Specified In The Description Of The Subject Of The Order Constituting Annex No. 3 To This Tor. 6. Materials, Devices And Equivalent Solutions: 1) Where The Description Of The Subject Of Delivery Or The Order Documents Indicates The Trademark (Brand), Manufacturer, Supplier, Patent, Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor Or Standards, European Technical Assessments, Common Technical Specifications Or Other References Referred To In Art. 101 Section 1 Point 2 Or Section 3 Of The Act, Public Procurement Law (Pzp), The Ordering Party, In Accordance With Art. 99 Section 5 Of The Public Procurement Law Allows The Submission Of An Equivalent Offer Or In Accordance With Art. 101 Section 4 Of The Public Procurement Act, Offering Solutions Equivalent To Those Indicated In The Documentation, Provided That They Ensure Technical Parameters Not Worse Than Those Assumed In The Documentation And Are Consistent In Terms Of: A) Dimensions And Construction (Size, Type, Physical Properties, Number Of Components), B) Functional Nature (Identity Of Functions), C) Material Characteristics (Type And Quality Of Materials), D) Technical Parameters (Strength, Durability, Technical Data, Hydraulic Data, Characteristics Linear, Structure), E) Operational Safety Parameters, F) Emission Standards, And Provided That The Contractor Proves It In Accordance With Art. 101 Section 5 Or 6 Of The Public Procurement Law.2) Each Time The Use Of An Alternative Solution Requires Agreement With The Ordering Party. Any Trademarks, Patents Or Origins Used In This Tor Should Be Interpreted As Definitions Of Standards, Not As Names Of Specific Solutions Applicable To The Project And Should Be Read With The Note Or Equivalent. 3)The Description Of The Delivery Item Shows The Minimum Properties Of The Products. The Contractor Relying On Equivalent Solutions Will Be Obliged To Demonstrate That They Meet The Requirements Specified In The Description Of The Subject Of The Order.4) Whenever The Documentation Mentions Polish Standards, It Should Be Understood As Polish Standards Transposing European Standards Or Standards Of Other Member States Of The European Economic Area Or Other Standards Or Documents Referred To In Art. 101 Section 1 Point 2 Of The Public Procurement Law.
