1) The Subject Of The Order Is: Reconstruction Of The Municipal Road No. 106168B Dobrochy-Szlasy Mieszki.2) The Detailed Scope Of The Subject Of The Contract Is Specified In The Design Documentation Constituting Annex No. 10 To The Swz.3) The Ordering Party Also Provides The Bills Of Quantities (Constituted As Annex No. 11 To The Swz). The Bills Of Quantities Attached To The Swz Constitute Only An Exemplary Calculation Of The Scope And Cannot Be The Only Basis For Calculating The Price Of The Entire Subject Of The Contract. The Contractor Should Remember, Notwithstanding Any Limitation Suggested By The Description Of Each Item And/Or Explanation, That The Price Shown In The Offer Constitutes Payment For Work Performed And Completed In All Respects. It Is Considered That The Contractor Has Taken Into Account All Requirements And Obligations, Regardless Of Whether They Were Specified Or Suggested In The Bill Of Quantities.4) If The Technical Documentation Would Indicate Trademarks, Patents Or Origin In Relation To Certain Materials Or Devices - The Ordering Party, In Accordance With Art. 99 Section 5 Of The Public Procurement Law, Allows Offering Equivalent Solutions. Materials Or Devices From Specific Manufacturers Determine The Minimum Quality Parameters And Functional Features That The Materials Or Devices Offered By The Contractor Must Meet In Order To Meet The Requirements Set By The Ordering Party. Materials Or Devices From Specific Manufacturers Constitute Only A Quality Standard Of The Subject Of The Order. The Use Of Exemplary Manufacturers Names Is Therefore Not Intended To Violate Art. 99 Section 4 Of The Public Procurement Law, But Specifying The Level Of Expectations Of The Employer In Relation To A Specific Solution. The Use Of Manufacturer Or Product Names Is For Example Purposes Only. By Indicating The Designation Of A Specific Manufacturer (Supplier) Or A Specific Product In The Description Of The Subject Of The Order, The Ordering Party Also Allows Equivalent Products With Quality Parameters And Functional Features At Least At The Level Of The Indicated Product, Thus Accepting Every Product With The Indicated Or Better Quality Parameters And Functional Features. 5) The Management Of Demolition Material Is The Contractors Responsibility. The Place Of Disposal Of Rubble And Excavated Material Along With Its Disposal Remains The Responsibility Of The Contractor And Constitutes Its Cost, Regardless Of The Distance Of Such Removal Suggested In The Bill Of Quantities.6) All Materials Related To The Correct And Complete Execution Of The Subject Of The Order Are Secured By The Contractor At Its Own Expense.7) The Contractor Will Perform All Necessary Research And Tests At Its Own Expense And Will Provide The Ordering Party With Documents, Including: As-Built Inventory, As-Built Documentation.8) Warranty Period: The Ordering Party Demands A Minimum 60-Month Warranty Period, Not Longer Than 84 Months, Counting From The Date Of Signing The A
