Portable Computers – Delivery Of Brand New Notebooks And Monitors. 1. The Subject Of The Basic Scope Of The Order Is The Supply Of Brand New Computer Equipment: - 16 Notebook - 222 Pcs. - 16 Notebook Type 2 - 1 Pc. - 23.8 Monitor - 157 Pcs. - Vertical Mouse - 253 Pcs. 2. The Offered Equipment Must Be Brand New And Come From Official Distribution Channels. 3. In Order To Reduce The Amount Of Waste, The Ordering Party Allows The Use Of Packaging 4. In Addition To The Basic Scope, The Ordering Party Is Entitled To Exercise The Option Right Referred To In Article 441 Of The Public Procurement Law, Increasing The Subject Of The Order By A Maximum Of: - 16 Notebook - 40 Pcs. - 16 Notebook Type 2 - 2 Pcs. - 23.8 Monitor - 40 Pcs. At Unit Prices For A Given Type Of Computer Equipment, Indicated In Table No. 2: Order Under The Option Right Of The Offer Form - Annex No. 3 To Swz). 5. The Ordering Party May Exercise The Option Right In Whole Or In Part. The Ordering Party Will Decide On The Possibility And Will To Exercise The Reserved Option Right In Accordance With Its Financial Capabilities. It Is Reserved That The Option Right Does Not Constitute A Contractual (Including Financial) Obligation Of The Ordering Party Incurred At The Time Of Concluding The Contract, And The Anticipated Optional Scope Of The Order Is Not Guaranteed To Be Implemented. The Optional Scope Indicated Above Constitutes The Maximum Scope Of The Reserved Option Right. The Contractor Is Obliged To Exercise The Reserved Option Right In The Case And To The Extent That It Is Used By The Ordering Party In Accordance With The Content Of The Ordering Partys Declaration On The Exercise Of The Option Right And The Conditions Specified In The Contract - At The Moment Of Submitting Such A Declaration, The Ordering Party Incurs A Financial Obligation In The Amount Resulting From The Scope Of Work Covered By The Option Implemented Under A Given Declaration. The Contractor Is Not Entitled To Any Claim Against The Ordering Party If The Ordering Party Does Not Exercise The Option Right. 6. The Rules For The Implementation Of The Subject Of The Contract Covered By The Option Right Regarding: The Method Of Its Implementation, Its Acceptance, The Required Standards And Technical Conditions, The Method Of Payment, The Method Of Security, The Method Of Calculating Contractual Penalties, The Exercise Of Rights And Obligations Arising From The Guarantee And The Cooperation Of The Parties Will Be The Same As Those Applicable To The Basic Subject Of The Contract. 7. The Ordering Party Will Notify The Contractor About Exercising The Option Right, Depending On Its Needs, No Later Than 6 Months From The Date Of Conclusion Of The Contract. The Ordering Party May Exercise The Option Right Once Or Several Times For A Different Amount Of Computer Equipment, But The Total Amount Of Computer Equipment May Not Exceed The Maximum Amount Of Computer Equipment Indicated In Section 4, And The Deadline Specified In The First Sentence Will Be Met. 8. If The Ordering Party Exercises The Option Right, The Delivery Of Computer Equipment Carried Out Under The Option Must Be Made And Delivered Within 60 Days From The Date Of Sending To The Contractor.
