1. Order Type: Delivery.2. The Subject Of The Order Is: Successive Delivery Of Food Products For Units Of The Wrocław University Of Environmental And Life Sciences (Also Called Products Or Assortment).3. A Detailed Description Of The Subject Of The Order Can Be Found In The Document Entitled: Description Of The Subject Of The Order - Assortment And Price Sheet, Which Is Annex No. 1.1 To Swz.4. The Detailed Scope Of The Contractors Obligations In The Scope Of The Implementation Of The Subject Of The Order Is Specified In The Document Entitled Drafted Provisions Of The Contract (Hereinafter: Ppu), Constituting Annex No. 3 To Swz.5. The Execution Of The Order Must Be Carried Out With Due Diligence, In Accordance With The Requirements Specified In The Swz, Its Annexes And Information Provided To The Contractors In The Course Of The Procedure.6. The Offer Must Be Clear And Comprehensive, I.E. It Must Include The Entire Range Indicated In The Assortment And Price Sheet. Therefore, The Contractor Is Obliged To Complete All Items Of The Assortment And Price Sheet By Providing Net Unit Prices And Calculating The Gross Offer Price For The Basic Order In Accordance With The Requirements Of The Ordering Party. If The Contractor Does Not Submit The Product And Price Sheet With The Offer, The Sheet Will Be Unsigned Or The Submitted Sheet Will Contain Errors That Cannot Be Corrected In Accordance With Art. 223 Section 2 Of The Public Procurement Law (E.G. Failure To Complete The Unit Price For Each Item Or The Unit Price Amounting To 0), The Ordering Party Will Not Request Its Submission Or Completion. An Offer That Is Not Accompanied By The Required Document Is Subject To Rejection Pursuant To Art. 226 Section 1 Point 5 Of The Public Procurement Law. 7. The Ordering Party Reserves The Right To Make Quantitative Changes Between Individual Product Items, While Maintaining The Principles Set Out In The Swz And The Draft Provisions Of The Agreement. The Quantities Indicated In The Assortment And Price Sheet Are Estimates, Refer To The Basic Order And Are Only Used To Compare And Evaluate Offers. The Actual Quantities Of Ordered Food Items May Differ From The Quantities Indicated In The Sheet, Depending On The Current Needs Of The Ordering Party.8. The Ordering Party Provides For The Possibility Of Exercising The Option Right Referred To In Art. 441 Of The Public Procurement Law, On The Terms Specified In The Swz And The Draft Provisions Of The Agreement.9. The Subject Of The Order In The Field Of Food Products Must Be Free From Physical And Legal Defects And Cannot Be Encumbered With The Rights Of Third Parties. The Delivered Assortment Is To Be Brand New.10. The Delivered Food Products Must Meet The Applicable Requirements Arising From Polish And European Union Law, Including Safety Standards Appropriate For This Type Of Product. 11. The Order Must Be Executed With Due Care And In Accordance With All The Requirements Contained In The Swz With Annexes And Any Info
