The Subject Of The Order Is The Supply Of Server And Network Equipment And Software Along With Implementation Services As Part Of The Cybersafe Waterworks Project. General Requirements For The Subject Of The Order:1) The Subject Of The Order Includes The Supply Of Hardware And Software To Individual Locations Of The Ordering Party In The Scope And Quantities Indicated In The Material And Quantity Statement.2) The Supplied Hardware And Software Must Be Brand New, Unused, Undamaged And Not Encumbered With The Rights Of Third Parties.3) The Devices Offered On The Day Of Submitting Offers Cannot Be Intended By The Manufacturer To Be Withdrawn From Production (So-Called End Of Life).4) The Supplied Hardware And Software Must Come From Official Distribution Channel In The Eu.5) The Contractor Will Ensure That The Equipment Is Packaged As Required To Prevent Its Damage Or Deterioration Of Its Quality During Transport To The Place Of Delivery.6) The Equipment Will Be Marked In Accordance With Applicable Regulations, In Particular Safety Signs.7) The Contractor Will Provide The Ordering Party With Instructions For Use Of The Equipment Or - If They Are Made Available By The Manufacturer In Electronic Form - Will Provide Web Addresses Where They Can Be Downloaded.8) For Software, The Contractor Is Obliged To Grant A Non-Exclusive License Appropriate For A Given Part Of The Ordering Party Or Transferring To The Ordering Party A Non-Exclusive License Right In Accordance With The Licensing Rules Specified By The Manufacturer.
