Promotional Services - Conclusion Of A Framework Agreement On The Selection Of A Contractor To Implement The Order Concerning The Preparation Of A Communication Strategy And Creative Concept As Well As Production Of Materials, Implementation Of Focus Research And Graphic Work As Part Of The Campaign Educational And Promotional Implemented By The Ministry Of Health. Conclusion Of The Framework Agreement, Description Of The Subject Of The Order, Individual Order, Order Form: 1. Pursuant To Art. 313 Of The Public Procurement Law. After Conducting The Proceedings, The Ordering Party Intends To Conclude A Framework Agreement Only With 1 (One) Contractor Who, Based On The Evaluation Of The Offers, Will Submit The Most Advantageous Framework Offer, Which Will Ensure The Best Quality Of Implementation Of The Subject Of The Agreement In Relation To The Offered Unit Prices For The Expected Individual Elements Of The Implementation Of The Subject Of The Framework Agreement. 2. The Framework Agreement Will Be Signed With The Contractor, Who Will Submit A Valid Framework Offer That Meets All The Requirements Specified In The Swz And The Public Procurement Law. 3. The Framework Agreement Will Be Signed By The Ordering Party Immediately After The Selection Of The Most Advantageous Framework Offer Becomes Final. The Ordering Party Envisages Concluding The Framework Agreement In Electronic Form Using A Qualified Electronic Signature. The Ordering Party Will Not Require The Contractor With Whom It Concludes The Framework Agreement To Provide Security For Its Proper Performance, Because A Public Contract Is Not Awarded. 4. The Conclusion Of The Framework Agreement Does Not Constitute The Award Of A Public Contract. The Fact Of Concluding The Framework Agreement Does Not Create Any Obligation To Contract On The Part Of The Ordering Party Or The Contractor Who Concluded It. 5. The Framework Agreement Should Be Understood As An Agreement Concluded Between The Ordering Party And One Contractor, The Purpose Of Which Is To Establish The Conditions For Individual Orders That May Be Placed By The Ordering Party During The Period Of Validity Of The Framework Agreement, In Particular Prices And, If Necessary, Expected Quantities Of Accepted Units. 6. The Framework Agreement Will Be Binding On Both Parties For Up To 24 Months From The Date Of Its Conclusion. 7. Following The Above, The Ordering Party Will Award The Order Or Orders Under The Terms Of The Order Specified In The Framework Agreement, Without Conducting A Procurement Procedure. 8. If Not All Conditions For The Implementation Of The Range Of Promotional Services Provided Are Specified In The Framework Agreement, The Ordering Party May Request The Contractor In Writing To Supplement The Offer. Then, The Content Of The Offer And, Therefore, The Content Of The Public Procurement Agreement Will Be Supplemented By The Contractor, E.G. By Adapting It To The Specific Circumstances Of A Given Order, Regardless Of The Possibility Of Introducing Significant Changes To The Framework Agreement. 9. Opz Was Created To Enable Contractors To Submit A Correctly Priced Framework Offer. 10. The Execution Of The Order Will Be Settled According To The Rates Given By The Contractor In The Detailed Cost Estimate For The Implementation Of The Subject Of The Framework Agreement, Presented In The Contractors Offer, The Template Of Which Is Annex No. 1 To The Opz (Annex No. 2 To The Swz). 11. The Contractor Is Obliged To Complete And Submit Together With The Offer The Attachment Detailed Cost Estimate For The Implementation Of The Subject Of The Framework Agreement - In Accordance With The Template Constituting Appendix No. 2 To The Swz. 12.
