The Subject Of The Order Is The Delivery And Installation Of Two Walk-In Climatic Chambers For Ihar-Pib, Branch In Poznań. The Scope Of The Order Includes Delivery To The Ordering Partys Headquarters, Transport And Unloading, Installation (Assembly), Connection, Commissioning (The Product Must Be Ready For Operation Without The Need To Purchase Additional Devices Or Software), Carrying Out Load (Validation) Tests And Providing The Necessary Documentation, As Well As Training The Ordering Partys Staff In Its Operation And Maintenance (Max. 6 Employees). 2. A Detailed Description Of The Subject Of The Order Is Included In The Description Of The Subject Of The Order (Appendix No. 1 To The Swz). 3. The Procedure Is Conducted As An Open Tender, In Accordance With Art. 132 Of The Act Of 11 September 2019 Public Procurement Law (Consolidated Text: Journal Of Laws Of 2024, Item 1320, As Amended), Hereinafter Referred To As The Act Or Upzp, With An Estimated Value Equal To Or Exceeding The Eu Threshold Within The Meaning Of Art. 3 Of The Act. 4. The Order Covered By These Proceedings Has Not Been Divided Into Parts. Dividing The Contract Into Parts Would Be Unjustified For Technical, Organizational And Expediency Reasons. The Ordering Party Does Not Allow The Submission Of Partial Offers, As It Is Not Justified Due To The Specific Nature Of The Delivery. Due To The Need To Coordinate The Scope Of The Order In A Very Short Implementation Time, Dividing The Order Into Parts Would Pose The Risk Of Generating Excessive Organizational And Technical Difficulties. The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Contract Could Seriously Jeopardize The Proper Execution Of The Contract. Therefore, Not Dividing The Contract Into Parts Was Dictated By Technical And Organizational Reasons And The Nature Of The Subject Of The Contract. Any Division Of The Order Into Lots Would Not Increase Competitiveness In The Small And Medium-Sized Enterprise Sector - The Scope Of The Order Is Typical, Enabling Contractors From The Group Of Small And Medium-Sized Enterprises To Submit An Offer. In Accordance With Recital 78 Of The Preamble To Directive 2014/24/Eu Of The European Parliament And Of The Council Of 26 February 2014 On Public Procurement, Repealing Directive 2004/18/Ec (Oj Eu L. Of 2014, No. 94, P. 65, As Amended), The Contracting Authority Should Be Obliged To Consider Advisability Of Dividing Orders Into Lots, While Retaining The Freedom To Make Autonomous Decisions On Any Basis It Deems Appropriate, Without Being Subject To Administrative Or Judicial Supervision. 5. If, When Describing The Subject Of The Contract, The Ordering Party Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 2 And Section 3 Of The Public Procurement Law, Solutions Equivalent To Those Described Are Allowed.
