The Subject Of The Order Is The Supply Of It Hardware And Software, Along With Installation, Configuration, Integration, Implementation, Training And Provision Of Warranty And Service, As Part Of The Project Development Of Digital Security In Zgk In Przytyk.2. All Solutions Delivered Must Be Brand New, Unused And Come From A Legal Distribution Channel Ensuring Full Manufacturer Support In The Eu. Refurbished Devices Or Licenses Are Not Permitted.3. Delivery, Including Transport, Unloading, Installation And Commissioning, Is At The Contractors Expense And Risk. The Contractor Will Provide Consolidated Transport By Grouping Shipments.4. The Detailed Scope Of The Subject Of The Order Is Specified In Annex No. 5 To The Swz - Description Of The Subject Of The Order, And The Requirements For The Implementation Of The Order Are Specified In Annex No. 6 To The Swz - Draft Contract.5. Equivalence Clause: 1) The Ordering Party, In Accordance With The Provisions Of Art. 99 Section 5 And Art. 101 Section 4 Of The Public Procurement Law, Allows Equivalent Solutions For Supplies, Materials And Systems That Meet The Requirements Specified In The Procurement Documents. Wherever The Content Of The Opz (Appendix No. 5 To The Swz) Indicates Trademarks, Patents Or The Origin Of Devices, Software Or Materials, They Should Be Treated Only As Proposals. The Ordering Party Allows Methods, Materials, Devices, Systems And Technologies Equivalent To Those Presented In The Opz. Therefore, It Is Allowed To Propose In The Offer Any Equivalent Market Equivalents With Properties Not Worse Than Those Indicated By The Ordering Party. The Parameters Indicated In The Procurement Documents Determine The Minimum Technical, Operational, Utility, Quality And Functional Conditions To Be Met By The Subject Of The Procurement. The Burden Of Proving Equivalence Rests With The Contractor. In The Case Of Equivalent Technologies, Systems, Materials Or Devices Accepted By The Contractor For The Valuation, The Offer Must Be Accompanied By A List Of These Technologies, Systems, Devices Or Materials Along With Documentation Of Equivalence (Certificates, Declarations Of Conformity, Catalog Cards, Software Sample To The Extent Indicated In The Opz). The Ordering Party Also Indicates, Pursuant To Art. 101 Section 4 Of The Public Procurement Law, That Wherever When Describing The Subject Of The Contract, Reference Is Made To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems. The Ordering Party Allows Solutions Equivalent To Those Described. In Such A Case, The Procedure Described In The Previous Content Of This Point Shall Apply Accordingly;2) In The Case Of Technologies, Systems, Materials Or Equivalent Devices Adopted By The Contractor For The Valuation, The Offer Must Be Accompanied By A List Of These Technologies, Systems, Devices Or Materials, Which Will Include: Type And Description Of The Technology Or System Used, Name Of The Device/Material Used, N
