Tenders Are Invited For Purchase Of Hand-Held Fire-Fighting Equipment For The Biebrza National Park

1. The Subject Of The Order Is The Purchase And Delivery Of Hand-Held Fire-Fighting Equipment, I.E. Sets For Extinguishing Grass And Forest Fires.2. A Detailed Description And Method Of Execution Of The Order Is Included In The Description Of The Subject Of The Order, Constituting Annex No. 1 To Swz.3. Wherever The Swz And Its Annexes Contain Terms Indicating Trademarks, Patents Or Origin, Sources Or A Specific Process That Characterizes Products Or Services Provided By A Specific Contractor, It Is Assumed That Such An Indication Is Accompanied By The Words Or Equivalent, And The Ordering Party Allows For The Possibility Of Contractors Offering Equivalent Products, Materials Or Devices. 4. Wherever The Ordering Party Describes The Subject Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law, It Is Assumed That Such A Reference Is Accompanied By The Words Or Equivalent, And The Ordering Party Allows Solutions Equivalent To Those Described. 5. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer A List Of Equivalent Solutions Along With Its Description Or Standards.6. If The Description Of The Subject Matter Of The Contract Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Act, The Ordering Party May Not Reject The Offer Just Because The Offered Supplies Are Not Consistent With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems To Which The Description Of The Subject Of The Order Refers, Provided That The Contractor Proves In The Offer That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Order.7. If The Description Of The Subject Of The Contract Refers To The Performance Or Functionality Requirements Referred To In Art. 101 Section 1 Point 1 Of The Public Procurement Law, The Ordering Party May Not Reject An Offer Compliant With The Polish Standard Transposing A European Standard, Standards Of Other Member States Of The European Economic Area Transposing European Standards, With A European Technical Assessment, With A Common Technical Specification, With An International Standard Or With A Technical Reference System Established By A European Standardization Body, If These Standards, Technical Assessments, Specifications And Technical Reference Systems Concern Performance Or Functionality Requirements Specified By The Ordering Party, Under Provided That The Contractor Proves In The Offer That The Delivery Or Service Meets The Performance Or Functionality Requirements Specified By The Ordering Party.
