Banking Services – Granting A Long-Term Loan. The Public Procurement Procedure Is Conducted In The Form Of An Open Tender Referred To In Art. 132 Of The Public Procurement Law, With A Contract Value Exceeding The Eu Thresholds Referred To In The Regulations Issued Pursuant To Art. 3 Of The Public Procurement Law Act Of September 11, 2019. Public Procurement Law (Consolidated Text: Journal Of Laws Of 2024, Item 1320, As Amended) [Hereinafter Referred To As The Pzp Act Or Pzp]. 1. In These Proceedings, The Ordering Party Will Apply The Provisions Of Art. 138 Section 4 Of The Public Procurement Law. Pursuant To Art. 138 Section 4 Of The Public Procurement Act, The Contracting Authority May Set A Deadline For The Submission Of Offers That Is 5 Days Shorter Than 35 Days From The Date Of Submission Of The Contract Notice To The Publications Office Of The European Union, If The Submission Of Offers Takes Place Entirely Using Electronic Means Of Communication. 2. Information About Prior Evaluation Of Offers; The Ordering Party Will Apply The Procedure Referred To In Art. 139(1) Of The Public Procurement Law (Reverse Procedure), I.E. 1) The Ordering Party Will First Examine And Evaluate The Offers, And Then Subjectively Qualify The Contractor Whose Offer Was Rated The Highest In Terms Of The Lack Of Grounds For Exclusion And Compliance With The Conditions For Participation In The Procedure. 2) In Connection With The Application Of The Procedure Referred To In Art. 139 Section 1 Of The Public Procurement Law, The Ordering Party Requires Submitting With The Offer A Declaration Of Not Being Subject To Exclusion And Meeting The Conditions For Participation In The Procedure Referred To In Art. 125 Section 1 On The Single Document Form (Jedz) 3. Other Provisions: 1) The Ordering Party Does Not Envisage An Electronic Auction. 2) The Ordering Party Does Not Provide For Any Requirement Or Possibility Of Submitting An Offer In The Form Of Electronic Catalogues. 3) The Ordering Party Does Not Conduct Proceedings To Conclude A Framework Agreement. 4) The Ordering Party Does Not Reserve The Right To Apply For The Contract Only By Contractors Referred To In Art. 94 Of The Public Procurement Law. 5) The Ordering Party Does Not Specify Additional Requirements Related To The Employment Of Persons Referred To In Art. 96 Section 2 Point 2 Of The Public Procurement Law. 6) The Ordering Party Does Not Allow The Submission Of Variant Offers. 7) The Ordering Party Does Not Envisage Awarding Contracts Referred To In Art. 214 Section 1 Point 7 Of The Public Procurement Law. 8) The Ordering Party Informs That No Preliminary Market Consultations Were Carried Out Before Initiating The Procedure. 9) The Ordering Party Does Not Provide For Reimbursement Of The Costs Of Participation In The Proceedings (Except For The Situation Referred To In Article 261 Of The Public Procurement Law). The Contractor Bears All Costs Of Participation In The Procedure, Including The Costs Of Preparing The Offer. 10) The Ordering Party Does Not Provide For Settlement In Foreign Currencies. Settlements Will Be Made In Polish Currency, I.E. Polish Zlotys. 11) The Public Procurement Procedure Is Conducted In Polish (Article 20(2) Of The Public Procurement Act).
