Construction Work For Pipelines, Communication And Power Lines, For Highways, Roads, Airfields And Railways; Flatwork – Construction Of Bicycle Infrastructure Along The Streets: Krasińskiego, Markwarta, Sieńki, Moniuszki, Skłodowska-Curie And Łęczycka In Bydgoszcz. Detailed Information Regarding The Subject Of The Order Can Be Found In Point 2.1 Of This Announcement. Moreover: Participation Of Contractors From Third Countries: 1. The Ordering Party Does Not Allow Contractors Who Run A Business And Have Their Registered Office Or Place Of Residence In Countries Other Than Member States Of The European Union And Other Than Countries That Are Parties To The Agreement On Government Procurement Of The World Trade Organization Or Parties To Other International Agreements Guaranteeing Access To The Public Procurement Market On The Basis Of Reciprocity And Equality, To Which The European Union Is A Party (So-Called Third Countries). An Offer Submitted By A Contractor From A Third Country Will Be Rejected Pursuant To Art. 226 Section 1 Point 2 Letter A Of The Public Procurement Law In Connection With Art. 11 Of The Public Procurement Law. 2. The Prohibition Referred To In Point 1 Also Applies To The Prohibition Of: 1) Applying For A Contract Jointly With Economic Operators From These Third Countries (Consortiums); 2) Relying On The Capabilities Or Situation Of Entities Providing Resources (Article 118(1) Of The Public Procurement Law) Originating From These Third Countries; 3) Entrusting The Performance Of Part Of The Contract To Subcontractors From These Third Countries And The Presence Of Such Entities As Subcontractors Providing Works, Services Or Supplies To The Contractors. In The Event Of Violating The Above Prohibitions, The Contractors Offer Will Be Rejected On The Basis Of The Relevant Provisions Of The Public Procurement Law, And The Ordering Party Will Not Consent To The Involvement Of Such Subcontractors At The Stage Of Contract Implementation. 3. Moreover, Contractors (And Subcontractors And Third Parties) To Whom Restrictive (Sanctioning) Measures Established In National And Eu Law Apply, In Particular: 1) Pursuant To Art. 7 Section 1 Of The Act Of April 13, 2022 On Special Solutions For Counteracting Support For Aggression Against Ukraine And For The Protection Of National Security; 2) Pursuant To Art. 5K Of Council Regulation (Eu) No. 833/2014 Of 31 July 2014 Concerning Restrictive Measures In Connection With Russias Actions Destabilizing The Situation In Ukraine. 4. The Offer Of The Contractor Who Is Subject To Exclusion Under The Sanction Provisions Referred To In Point 3 Is Subject To Rejection Pursuant To Art. 226 Section 1 Point 2 Letter And The Public Procurement Law. In Order To Confirm The Lack Of Grounds For Exclusion In This Respect, The Contractor Submits An Appropriate Declaration Along With The Offer (In The Content Of The Bid Form Or Declaration Of Non-Exclusion). Whistlebell Protection: In Accordance With The Provisions Of The Act Of June 14, 2024 On The Protection Of Whistleblowers, The Ordering Party Has Implemented A Procedure For Reporting Violations Of The Law And Taking Follow-Up Actions, Which Is Described In Order No. 20/2024 Of The Director Of Zdmikp In Bydgoszcz Of September 18, 2024.
