The Subject Of Procurement Is The Continuation Of The Enterprise Contract For A Duration Of 36 Months Starting Predictably From 1 October 2026. Ending With 30.9.2029. The Subject Of Procurement Are Licenses For The Use Of Microsoft Software With Which Microsoft Directly Or Indirectly Provides Certain Services, Grants Certain Rights, I.E. Provides Additional Benefits And/Or Opportunities, In Accordance With The Technical Features And Other Required Conditions Specified In This Bidding Documentation. The Offeror Is Obliged To Comply With The General Conditions And The Accompanying Ms (Microsoft) Documentation, Which Have Been Determined By Microsoft As The Holder Of Copyrights, I.E. Intellectual Property Rights, For Enterprise Volume Licensing Programs. This Procurement Envisages The Maintenance Of Existing And Procurement Of New Ms Licenses, With The Aim Of Maintaining The Benefits Provided By The Mbsa Contract In Accordance With The General And Special Conditions And Licensing Rules Of Microsoft For Enterprise Users. Maintenance Of Existing Ms Products Implies The Continuation Of The Right To Use Existing Ms Products And A Mandatory Technological Guarantee (Sa - Software Assurance). Mandatory Technological Warranty Includes Technical Maintenance Of Previously Purchased Ms Products In The Period From October 1, 2026. Until 30.9.2029. The Procurement Of New Additional On-Premise Ms Products Will Be Carried Out Through The So-Called Lic/Sa Or Trueup Model, Which Includes The Delivery Of The Same, The Right To Use Newly Acquired Ms Products And The Mandatory Technological Guarantee (Sa - Software Assurance). Based On The Ms Volume Licensing Program Enterprise, The Client Acquires The Permanent Right To Continuous And Uninterrupted Use Of Purchased On-Premise Licenses, Regardless Of Their Type (Sa, Lic/Sa Or Trueup) For The Duration And After The Expiration Of The Contract, I.E. The Enterprise Contract, Without Paying Any Additional Fee. Upon Expiration Of The Contract, I.E. The Enterprise Contract, The Client Loses The Rights Arising From The Technological Guarantee And The Right To Additional Benefits.
