1. The Subject Of The Order Are Construction Works Entitled: Renovation Works And Removal Of Storm Sewage Failures For A Period Of 36 Months.2. The Basic Scope Of Works Includes In Particular: A) Earthworks, Demolition And Surface Works, B) Assembly, Renovation Works And Repairing Failures On Pipelines And Stormwater Network Elements, C) Cleaning Of Stormwater Network Elements. A Detailed Description Of The Subject Of The Order And The Technical Specifications For The Execution And Acceptance Of Works (Stwior) Constitute Appendix No. 9 And 10 To The Swz, Respectively. 3. The Conditions For The Execution Of The Order Are Specified In The Draft Provisions Of The Contract Constituting Annex No. 7 To Swz.4. The Ordering Party Requires Special Caution In Carrying Out The Works, In Particular Ensuring Appropriate Security And Shielding, Keeping The Construction Site In Good Order, Organizing Construction Works In A Way That Does Not Endanger People Using Properties Adjacent To The Scope Of The Task. Due To The Above, The Contractor Must Include The Costs Of Securing The Performance Of Works In The Offer Price. This Cost Should Be Included In Indirect Costs. 5. The Ordering Party, Pursuant To Art. 95 Of The Public Procurement Law, Requires The Contractor Or Subcontractor To Employ, Under An Employment Relationship, Persons Performing Activities Related To The Execution Of The Order, The Performance Of Which Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Consolidated Text: Journal Of Laws Of 2025, Item 277). The Above Employment Requirement Based On An Employment Relationship Applies To Manual Workers Directly Performing Construction Works Covered By The Subject Of The Contract In The Scope Of: A) Earthworks, Demolition And Surface Works, B) Assembly, Renovation Works And Removal Of Failures On Pipelines And Elements Of The Storm Sewage System, C) Cleaning Of Elements Of The Storm Sewage Network. The Above Requirement Does Not Apply To Freelancers, Including Designers, Construction Managers And Works Managers. 6. At Each Stage Of The Implementation Of The Subject Of The Contract, The Ordering Party Has The Right To Demand That The Contractor Prove The Fact That People Are Employed Under An Employment Contract. 7. In Case Of Justified Doubts As To Compliance With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate. 8. Detailed Requirements Regarding The Implementation And Enforcement Of The Employment Requirement Based On An Employment Relationship Are Specified In The Draft Provisions Of The Contract, Constituting Annex No. 7 To Swz.9.
