1. The Subject Of The Order Is The Construction Of A Fountain At The Roundabout. Polish Army In Nowe Miasto Nad Pilicą - Design And Build Formula.2. A Detailed Description Of The Subject Of The Order Can Be Found In The Functional And Utility Program (Part Iii Of The Swz) And In The General Terms And Conditions Of The Contract For The Performance Of Design And Construction Works (Part Iv Of The Swz).3. The Contractor Is Obliged To Ensure, At Its Own Expense, Safe Road And Pedestrian Traffic Conditions In The Area Of ​​Works Covered By The Contract On The Basis Of A Traffic Organization Design For The Duration Of Construction Prepared By And At The Contractors Expense. The Contractor Is Obliged To Develop Permanent Traffic Organization.4. If Trademarks, Patents Or Origin, Source Or Specific Process That Characterize The Product Or Services Provided By A Specific Contractor Are Indicated In The Description Of The Subject Of The Order, The Ordering Party Allows Equivalent Solutions. If The Description Of The Subject Of The Order Refers To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems, The Ordering Party Allows Solutions Equivalent To Those Described. 10. Throughout The Entire Period Of Execution Of The Contract With Mzdw In Warsaw, The Contractor Is Obliged To Have Valid Civil Liability Insurance (Oc) For The Implementation Of Construction Works Entrusted To Be Performed Under The Contract With Mzdw In Warsaw For A Guarantee Sum Of At Least Pln 500,000.00. 11. The Contractor Is Obliged To Submit A Policy Confirming Compliance With The Above. Requirement Within No More Than 7 Days From The Date Of Conclusion Of The Contract. 12. If The Insurance Policy Presented By The Contractor Does Not Cover The Entire Duration Of The Contract, The Contractor Is Obliged To Present The Ordering Party With Another Insurance Policy That Meets The Above-Mentioned. Requirements No Later Than 7 Days From The Expiry Of The Previous Policy.13. If The Contractor Fails To Fulfill The Above Obligation, The Ordering Party Will Charge The Contractor Contractual Penalties For Delay In The Amount Specified In The Contract. If A Copy Of A Current And Paid Insurance Policy (Oc) Is Not Submitted Within 30 Days From The Date Of Conclusion Of The Contract, The Ordering Party Will Have The Right To Withdraw From The Contract For Reasons Attributable To The Contractor.
