The Subject Of The Order Are Construction Works Entitled: Construction Of An Office Building By Exposing A Combination Of Old And Modern Architectural Elements As Part Of The Revitalization Of The Space Of The Lower Town Of Gdańsk, Including Equipment And Preparation Of Design Documentation, Including: 1) Task No. 1 - Construction Of The Shell Of The U-1 Hiding Place In Order To Protect The Population In Crisis Situations 2) Task No. 2 - Construction Of The U-1 Hiding Place In Order To Protect The Population In Crisis Situations 3) Task No. 3 - Construction Of An Office Building By Exposing A Combination Of Old And Modern Architectural Elements As Part Of The Revitalization Of The Lower Town Of Gdańsk. 2. The Subject Of The Contract Referred To In Section 1, Will Be Implemented At Ul. Augustyńskiego 1 In Gdańsk, Plot No. 214/7, 214/9 And 214/3, Precinct 0099, In Accordance With The Design Documentation. 3. The Description Of The Subject Of The Order Is Specified In: • Annexes No. 1.1-1.3 To The Swz; • The Draft Contract, Which Constitutes Annex No. 2 To The Swz. 4. The Minimum Quality Guarantee Period Required By The Ordering Party For Construction Works And Installed Devices Is 60 Months. Regardless Of The Quality Guarantee Granted For Construction Works, Which Is The Criterion For Evaluating The Offers, The Contractor Is Liable To The Ordering Party Under The Warranty For Defects, On The Terms Set Out In The Civil Code, I.E. The Contractor Is Liable Under The Warranty If A Physical Defect Is Detected Within Two Years, And In The Case Of Real Estate Defects - Within Five Years From The Date Of Final Acceptance. 5. The Contractor Is Obliged To Analyze The Solutions Presented In The Tender Documentation In Terms Of The Adopted Technical Solutions And System Optimization. 6. The Law Applicable To This Order (Including The Contract Concluded As A Result Of These Proceedings And For The Assessment Of The Legal Effects Of All Documents In This Order) Is Polish Law, Taking Into Account European Union Law. 7. In All Provisions Of The Swz And Its Annexes In Which The Ordering Party Refers To Standards, Approvals, Technical Specifications Or Reference Systems Or Indicates Trademarks, Parameters Or Sources Of Origin (Names Of Manufacturers Or Devices), In Accordance With Art. 99 Section 5 And Art. 101 Section 4 Of The Public Procurement Law, The Ordering Party Allows Equivalent Solutions. 8. If The Annexes Constituting The Description Of The Subject Of The Order Include The Names Of Materials And Products Of Specific Manufacturers, This Should Be Treated Only As A Definition Of The Desired Standard And Quality. In All Such Situations, The Contractor May Offer Equivalent Materials And Products With At Least The Same Technical And Quality Parameters. Product Equivalence Means Offering A Product Whose Technical Parameters Of The Materials Used, Efficiency, Durability And Quality Are Not Inferior To The Quality Of The Materials And Products Described In The Swz. 9. The Contractor Who Relies On Equivalent Solutions Is Obliged To Demonstrate That He Offers
