The Public Procurement Procedure Is Conducted In The Form Of An Open Tender Pursuant To The Act Of September 11, 2019, Public Procurement Law (Journal Of Laws Of 2026, Item 793, As Amended), Hereinafter Referred To As The Public Procurement Law. 2. The Ordering Party Provides For The Possibility Of Applying The Procedure Specified In Art. 139 Of The Public Procurement Law, May First Examine And Evaluate The Offers, And Then Subjectively Qualify The Contractor Whose Offer Was Rated The Highest In Terms Of The Lack Of Grounds For Exclusion And Compliance With The Conditions For Participation In The Procedure. 3. The Proceedings Are Conducted In Polish. 4. Pursuant To Art. 257 Of The Public Procurement Act, The Contracting Authority May Invalidate The Contract Award Procedure If The Public Funds That The Contracting Authority Intended To Use To Finance All Or Part Of The Contract Were Not Granted To It, And The Possibility Of Invalidating The Procedure On This Basis Was Provided For In The Contract Notice - In The Procedure Conducted Under Open Tendering. 5. Due To The Specific Nature Of The Order, The Ordering Party Requires The Contractors To Participate In A Mandatory On-Site Inspection. 6. The Site Visit Takes Place After Prior Individual Arrangement Of The Date With The Ordering Party. The Application Should Be Sent To [email protected] 7. Participation In An On-Site Visit To The Clinic At Ul. Żeromskiego 13 Is Mandatory And Is A Necessary Condition For Submitting A Valid Offer. 8. Lack Of Confirmed Participation In The Mandatory On-Site Visit Will Result In Rejection Of The Contractors Offer Pursuant To Art. 226 Section 1 Point 18 Of The Public Procurement Law. The Contractor Is Obliged To Confirm His Presence By Signing The On-Site Inspection Report. 9. Contractors Participate In The Site Visit At Their Own Risk. The Ordering Party Is Not Responsible For Any Accidents, Injuries Or Property Damage As Well As Costs Incurred During The On-Site Visit. 10. During The On-Site Visit, The Ordering Partys Representatives Will Not Provide Answers To Questions Regarding The Subject Of The Order Or Swz. Such Questions Should Be Submitted Via The Website Of The Ongoing Proceedings, Referred To In Chapter I, Section 4 Of This Tor. 11. The Contractor May Attach The On-Site Inspection Report (Scan, Photo) To The Offer.
