The Subject Of The Order Must Be Free From Any Physical And Legal Defects, Approved For Trading Under Applicable Law, And In Particular Meet The Requirements Of The Current Polish Standards Pn-En 1789 And Pn-En 1865 Or Equivalent Standards, Because In Accordance With Art. 36 Section 2 Of The Act Of September 8, 2006 On State Emergency Medical Services (Journal Of Laws Of 2026, Item 141), A Specialized Means Of Sanitary Transport (Ambulance) Must Meet The Technical And Quality Features Specified In The Polish Standards Transposing European Harmonized Standards. In Addition, Each Type C Sanitary Ambulance Complies With The Technical Parameters Described In Annex 2 To The Swz, And Also Has The Necessary Approvals For The Base Vehicle And A Completely Built-In Sanitary Ambulance. If The Description Of The Subject Of The Order Contains Any Trademarks, Patents Or Origin Of The Source Or A Specific Process That Characterizes The Products Supplied By A Specific Contractor - It Should Be Assumed That The Ordering Party Has Provided A Description With An Indication Of The Type And Allows The Submission Of Equivalent Offers With Technical, Operational And Utility Parameters Not Worse Than Those Given In The Description Of The Subject Of The Order (Legal Basis - Article 99(5) Of The Act). 6. If The Description Of The Subject Of The Contract Includes Standards, Technical Assessments, Technical Specifications Or Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act, It Should Be Treated Only As An Aid In The Description Of The Subject Of The Contract. Equivalent Solutions Are Acceptable In Each Case. The Ordering Party Will Not Reject The Offer For Lack Of Compliance With The Above-Mentioned Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Act, Provided That The Contractor Proves In The Offer, In Particular By Means Of Evidence, That The Proposed Solutions Meet The Requirements Specified In The Description To An Equivalent Extent.
