1. The Subject Of The Order Are Construction Works Entitled: Reconstruction Of The Sidewalk On T. Kościuszki Street In Giżycko (From Ul. Wodociągowa To Ul. Staszica), Plot No. 254, District 0002 City Of Giżycko. 2. The Basic Scope Of Works Includes In Particular: A) Earthworks, Preparatory And Accompanying Works, B) Renovation Of The Sidewalk, C) Construction Of A Parking Bay, D) Construction Of Signage Vertical, E) Finishing And Accompanying Works. A Detailed Description Of The Subject Of The Order Is Included In The Design Documentation And Stwiorb, Constituting Annex No. 9 To The Swz 3. The Ordering Party Requires Special Caution In Carrying Out The Works, In Particular Ensuring Appropriate Security And Protection, Keeping The Construction Site In Good Order, Organizing Construction Works In A Way That Does Not Endanger People Using The Given And Neighboring Properties With The Scope Of The Investment Task. Therefore, The Contractor Must Include The Costs Of Securing The Execution Of The Works In The Offer Price Be Included In Indirect Costs. 4. Pursuant To Article 95 Of The Public Procurement Law, The Contractor Or Subcontractor Must Employ, On The Basis Of An Employment Relationship, Persons Performing Activities Related To The Execution Of The Order, The Performance Of Which Involves Performing Work In The Manner Specified In Article 22 § 1 Of The Act Of June 26, 1974, Labor Code. As Amended) The Above Requirement For Employment Under An Employment Relationship Applies To Manual Workers Directly Performing Construction Works Covered By The Subject Of The Contract In The Scope Of: A) Demolition And Earthworks, B) Road Works (Sidewalk, Parking Bay), C) Landscaping With Greenery, D) Operation Of Machines, Vehicles, Equipment And Devices. The Above Requirement Does Not Apply To Persons Performing Freelance Professions, Including Designers, Construction Managers And Works Managers. 5. The Contractor Is Obliged To Sign The Contract Submit A List Of These Persons Along With A Statement Confirming Their Employment Under An Employment Contract, And, At The Request Of The Ordering Party, Evidence Indicating Their Employment Under An Employment Contract. After Concluding The Contract, The Contractor Is Also Obliged, At Each Request Of The Ordering Party, To Submit A List Of Persons Together With A Statement Confirming Their Employment Under An Employment Contract And That They Are Not In Arrears With The Payment Of Remuneration As At The Date Of Submitting The Declaration Doubts As To Compliance With Labor Law By The Contractor Or Subcontractor, The Ordering Party May Request An Inspection By The National Labor Inspectorate. 7. Detailed Requirements Regarding The Implementation And Enforcement Of The Employment Requirement Based On The Employment Relationship Are Specified In The Draft Provisions Of The Contract, Constituting Annex No. 6 To The Swz. 96 Of The Act. 9.
