The Subject Of The Order Is The Preparation Of Design Documentation And Construction Works For The Investment Project Entitled: Development Of The Green Area Between Kindergarten No. 17 And Primary School No. 7 At Ul. Tolstoja In Tychy. The Subject Of The Contract Includes The Following: 1) Development Of Design Documentation To The Extent Necessary To Perform The Subject Of The Order In Accordance With The Scope Included In The Contract And The Ffu, 2) Performing Authors Supervision, 3) Execution Of Construction Works Based On The Design Documentation And Technical Specifications For The Execution And Acceptance Of Works. The Detailed Scope Of The Subject Of The Order Is Specified In The Functional And Utility Program (Ffu) Constituting Annex No. 4 To The Swz. 1. If Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes Products Or Services Provided By A Specific Contractor Are Indicated In The Order Documents, The Ordering Party Allows The Use Of Materials Equivalent To Those Described.2. If The Description Of The Subject Of The Contract Includes References To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Act, The Ordering Party Allows Solutions Equivalent To Those Described.3. A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Attaches To The Offer Documents Confirming The Equivalence Of The Offered Solutions. The Burden Of Proving Equivalence Rests With The Contractor.
