The Subject Of This Public Procurement Includes The Exercise Of Authors Supervision During The Implementation Of Construction And Installation Works For The Reconstruction And Additional Construction Of The Water And Sewage Network In The Iii-Th District Of The Town Of Kostinbrod, Community. Kostinbrod. The Service Of Exercising Author Supervision Includes Control Over The Legal And Accurate Execution Of Construction In Accordance With The Prepared Investment Project, Giving Instructions And Prescriptions During Construction, Participation, If Necessary, In The Drawing Up Of Acts And Protocols During Construction, As Well As Participation In Putting The Construction Into Operation. According To The Provision Of Art. 162, Para. 2 Of The Law On Territorial Planning, The Designer Is Obliged To Exercise Authors Supervision During Construction Regarding Compliance With The Approved Investment Project. According To Art. 162, Para. 3 Of The Zut, The Instructions Of The Designer, Related To His Copyright, For The Exact Observance Of The Investment Project Made By Him, Are Mandatory For All Participants In The Construction. According To The Provision Of Art. 18, Para. 2, Item 9, In Connection With Art. 3, Para. 1, Item 8 Of The Law On Copyright And Its Related Rights, Investment Projects, Schemes, Plans And Other Documents Related To The Organization Of The Territory Are The Subject Of Copyright, And The Copyright Arises For The Author With The Creation Of The Relevant Project. Due To The Existence Of Exclusive Rights And The Impossibility Of The Subject Of The Order Being Performed By Another Person, The Prerequisites Of Art. 79, Para. 1, Item 3, Letter C Of The Zop For Awarding Through A Negotiation Procedure Without Prior Announcement. On The Basis Of Art. 65, Para. 1 Of Ppzop, The Contracting Authority Shall Not Apply Art. 64, Para. 2 And Para. 3 Of The Ppzop, Accordingly, Will Not Send An Invitation To Participate And Will Not Require The Submission Of An Offer From The Designated Contractor. Non-Application Of The Specified Provisions Is Conditioned By The Right Of The Contracting Authority Under Art. 65, Para. 1 Of Ppzop Not To Apply Art. 64, Para. 2 And Para. 3 Of The Ppzop, And From The Nature Of The Present Procedure, Which Is Conducted On The Basis Of Art. 79, Para. 1, Item 3, Letter C Of The Zop - Existence Of Exclusive Rights, Including Intellectual Property Rights.
