Prior Information Notice For Public Road Transport Services – Awarding Of Passenger Transport Services In Regular Motor Vehicle Services In The Ludwigsburg And Rems-Murr Districts; Line Bundle Lb06 “Marbach” Lot 1 In The Open Procedure.. The Districts, As Responsible Authorities And Responsible Authorities, Intend To Award A Public Service Contract (Ödla) For Public Passenger Transport Services With Motor Vehicles In Accordance With Section 2 (1) Pbefg In Accordance With Section 6 Para. 1, 3 Öpnvg-Bw In Conjunction With Section 8A Pbefg And Art. The Award Is Made Through The Open Procedure. The Subject Of The Intended Ödla Are The Public Passenger Transport Services On Lines 443, 451, 456, 456A And 457. There Are Two Timetable States (See Supplementary Document). Timetable State 1 Covers The Period From Commissioning Up To And Including December 31, 2029; Timetable Status 2 The Period From January 1St, 2030 Until The End Of The Term. Line 451 Can Only Be Operated In Timetable Status 2 (From January 1St, 2030). The Transport Services Included At The Start Of Operations (See Section 5.1.3.) Are Described In The Supplementary Document (See Section 2.1.4.). In Total, According To The Current Planning Status, The Transport Services To Be Awarded In Timetable State 1 Amount To 777,376 Commercial Vehicle Kilometers Per Year And 859,342 Commercial Vehicle Kilometers In Timetable State 2. This Is Regular Service In Accordance With Section 42 Pbefg, Which Is Awarded As A Total Service. The Districts Reserve The Right To Adapt The Transport Services Within The Framework Of The Award To Changing Transport Needs, Financial Conditions Or An Update Of The Local Transport Plan During The Term Of The Public Service Contract. The Modalities For Adapting The Transport Offer Are Determined In The Public Service Contract. Even In The Case Of Self-Financed Transport, It Is Possible To React To Changing Transport Needs Or Financial Conditions Or To Update The Local Transport Plan In Coordination Between The Responsible Authorities And The Licensing Authority, As Long As This Does Not Significantly Change The Transport Performance. The Operator Is Granted An Exclusive Right Within The Meaning Of Article 2 Lit. F Of Regulation (Ec) No. 1370/2007. According To Section 8A Paragraph 8 Pbefg, The Exclusive Right Only Relates To The Protection Of Transport Services That Are The Subject Of The Public Service Contract And That Have A More Than Insignificant Impact On The Passenger Potential Of These Services. The Responsible Authority Determines The Spatial And Temporal Scope As Well As The Type Of Passenger Transport Services That Are To Be Provided To The Exclusion Of Other Operators. The Operator Must Comply With The Requirements Of The Baden-Württemberg State Tariff Compliance And Minimum Wage Act (Ltmg). In Particular, The Relevant And Representative Collective Agreements ((Bz) Tv-Nbw, Wbo) Must Be Adhered To.
