Electricity, Heating, Solar And Nuclear Energy - Supply Of Electricity With Distribution Service For The Needs Of Eś, Municipalities And Their Organizational Units And Other Entities Belonging To The Purchasing Group. 1. The Subject Of The Order Is A Comprehensive Supply Of Electricity, Including The Sale Of Electricity And The Provision Of Electricity Distribution Services Via The Distribution Network Belonging To The Distribution System Operator To The Consumption Points Of Entities Jointly Applying For The Order, In Accordance With The List Set Out In Annexes No. 2A And 2B To The Swz. The Scope Of The Order Includes The Sale And Distribution Of Electricity To The Indicated Entities In 2027, In An Amount Consistent With The Estimated Demand Of 85,400,971.720 Kwh. 2. The Projected Electricity Consumption During The Term Of The Contract For Individual Ordering Parties Is For: - Eoś Sp. Z O.O. - 30,000,000.00 Kwh - Municipalities With Organizational Units / Other Entities - 55,400,971.72 Kwh Detailed Data Regarding The Delivery And Service Are Included In The Price Form - Annex No. 3B To Swz 3. The Estimated Amount Of Delivery Does Not Constitute An Obligation On The Part Of The Ordering Party To Consume Energy In The Given Amount And Cannot Under Any Circumstances Constitute The Basis For Any Claims On The Part Of The Contractor. The Actual Amount Of Purchased Energy, Confirmed By The Readings Of Measurement And Billing Systems During The Execution Of Contracts, Will Result Solely From The Current Needs Of The Ordering Party. During The Execution Of This Order, The Ordering Party Reserves The Right To Increase The Total Amount Of Purchased Energy By Up To + 20% Compared To The Amount Specified In Point 2 - Basic Scope. Pursuant To Art. 433 Point 4 Of The Public Procurement Law, The Ordering Party Declares That The Quantity Of Ordered Energy Will Not Be Reduced By More Than 5% Of The Original Scope Of The Order. The Above Circumstance, I.E. Reducing The Amount Of Energy Ordered To The Indicated Percentage, Will Not Affect The Change In The Amount Of The Contractors Unit Rates. Electricity Supplies Will Meet The Quality Standards Specified In The Energy Law And Implementing Acts. 4. The Ordering Party Has The Right To Change The Number (Increase, Decrease) Of Electricity Consumption Points During The Execution Of The Subject Of The Order, And The Price Rates Given In The Offer Form Also Apply To New/Additional Electricity Consumption Points. 5. The Ordering Party Provides For The Possibility Of Increasing Electricity Supplies Using The Option Right Referred To In Art. 441 Of The Public Procurement Law. The Option Right Is The Possibility Of Increasing The Supply Of Electricity Under The Terms Of The Concluded Contract To 20% Of The Basic Order. The Ordering Party Makes The Exercise Of The Option Right Conditional On The Addition Of New Electricity Consumption Points To The Ppe Listed In Annex No. 3B To The Swz, Resulting In An Increase In The Demand For Electricity Supply Above The Basic Demand. The Option Right Is An Entitlement Of The Ordering Party, Which He May, But Does Not Have To, Exercise As Part Of The Implementation Of The Contract. If The Ordering Party Does Not Exercise The Option, The Contractor Is Not Entitled To Any Claims
