All Contractors Who Are Not Subject To Exclusion Under The Principles Set Out In Chapter Ix Of The Swz And Who Meet The Conditions For Participation In The Procedure May Apply For The Award Of The Contract. 1.1. Contractors Who Meet The Conditions Regarding: 1) The Ability To Engage In Business Transactions May Apply For The Contract: The Ordering Party Does Not Impose A Condition 2) Authorization To Conduct Specific Business And Professional Activities, Provided That This Results From Separate Regulations: The Ordering Party Will Consider The Condition To Be Met If The Contractor Submits A Valid Permit To Conduct Banking Activities In Poland, As Well As For The Provision Of Services Covered By The Subject Of The Order In Accordance With Applicable Law (Act Of August 29, 1997 (Journal Of Laws Of 2026, Item 38) Banking Law, Act Of December 7, 2000 On The Operation Of Cooperative Banks, Their Association And Associating Banks, And In The Case Specified In Article 178(1) Of The Banking Law - Another Document Confirming The Commencement Of Business Activity: The Ordering Party Does Not Impose Any Condition In This Regard. 4) Technical Or Professional Capacity: The Ordering Party Does Not Impose Any Conditions In This Respect. 2. When Assessing The Technical Or Professional Capacity, The Ordering Party May, At Any Stage Of The Procedure, Consider That The Contractor Does Not Have The Required Capabilities, If The Contractors Conflicting Interests, In Particular The Involvement Of The Contractors Technical Or Professional Resources In Other Economic Ventures Of The Contractor, May Have A Negative Impact On The Execution Of The Order. 3. The Condition Regarding The Authorization To Conduct A Specific Business Or Professional Activity Will Be Met If At Least One Of The Contractors Jointly Applying For The Award Of The Contract Has The Authorization To Conduct A Specific Business Or Professional Activity And Will Carry Out Construction Works, Supplies Or Services For Which These Authorizations Are Required. 4. With Regard To The Conditions Regarding Education, Professional Qualifications Or Experience, Contractors Jointly Applying For The Award Of A Contract May Rely On The Abilities Of Those Contractors Who Will Perform Construction Works Or Services For Which These Abilities Are Required. 5. In The Case Referred To In Point 3 And 4, Contractors Jointly Applying For The Award Of A Contract, Including Civil Partnerships, Are Obliged To Attach To Their Offer A Statement Which Will Indicate Which Construction Works, Supplies Or Services Will Be Performed By Individual Contractors. The Declaration Template Is Attached As Annex No. 3 To The Swz. 6. The Contractor Who Relies On The Capabilities Or Situation Of Entities Providing Resources Is Obliged To Submit, Along With The Offer, An Obligation Of The Entity Providing Resources To Provide It With The Necessary Resources For The Purpose Of Executing The Order Or Other Subjective Evidence Confirming That The Contractor Will Have The Necessary Resources When Executing The Order.
