The Subject Of The Order Is The Supply Of Electricity To Buildings Located In Poznań At Al. Niepodległości 34, Ul. Kościuszki 95 And Ul. Nowowiejskiego 37 In The Years 2027-2028. 2. A Detailed Description Of The Subject Of The Contract Is Specified In The Description Of The Subject Of The Contract (Opz) Constituting Annex No. 2 To The Swz And In The Draft Provisions Of The Contract (Ppu) Constituting Annex No. 3 To The Swz. 3. The Ordering Party Requires That The Subject Of The Order Be Performed In Accordance With The Requirements Contained In The Tor. 4. The Expected Amount Of Electricity Consumption For The Collection Points Specified In The Description Of The Subject Of The Order (Appendix No. 2 To The Swz) And In The Offer Form (Appendix No. 1 To The Swz), Constituting The Order, Is An Amount Estimated With Due Care. However, The Above Data Is Of Informative Nature, It Is Used To Calculate The Offer Price And Compare Offers, And Cannot Be The Basis For Any Claims On The Part Of The Contractor. The Contractors Remuneration Will Be Calculated According To The Unit Prices Specified In The Offer And The Actual Amount Of Electricity Consumed By The Ordering Party During The Order Execution Period. 5. The Subject Of The Order Is The Supply Of Electricity In Accordance With The Act Of April 10, 1997, Energy Law (Journal Of Laws Of 2026, Item 43, As Amended) Together With The Implementing Provisions Of This Act. 6. The Distribution Service Will Be Provided On The Basis Of An Agreement Concluded With The Local Distribution Network Operator, I.E.: Enea Operator Sp. Z O. O., Ul. Strzeszyńska 58, 60-479 Poznań. 7. The Contractor Undertakes To Act As The Entity Responsible For Commercial Balancing For The Electricity Sold Under This Agreement. 8. The Contractor Will Perform Commercial Balancing Of The Energy Purchased By The Ordering Party On The Basis Of A Standard Consumption Profile With The Contractual Power Specified In The Description Of The Subject Of The Order. 9. Costs Resulting From Balancing Should Be Included In The Price Of Electricity. 10. The Ordering Party Declares That All Rights And Obligations Related To Commercial Balancing Are Transferred To The Contractor. 11. Electricity Purchased Under The Agreement Will Be Used For The Needs Of The End User, Which Means That The Ordering Party Is Not An Energy Company Within The Meaning Of The Energy Law. 12. The Supplied Electricity Must Meet Technical Standards In Accordance With The Provisions Of The Act Of April 10, 1997 - Energy Law And The Implementing Regulations To This Act And Polish Standards. 13. In The Event Of Failure To Meet Quality Service Standards, The Ordering Party, Upon Its Written Request, Is Entitled To A Discount According To The Rates Specified In The Regulation Of The Minister Of Energy Of March 6, 2019 On Detailed Rules For Shaping And Calculating Tariffs And Settlements In Electricity Trading Or In Any Legal Act Issued Regarding Quality Service Standards. 14.
