Subject Of The Order: Supply And Distribution Of Electricity For A Period Of 24 Months To Buildings And Electricity Consumption Points Of The National Institute Of Public Health Pzh - National Research Institute (Hereinafter Referred To As Nizp Pzh - Pib), In Two Locations, I.E. At Ul. Chocimska 24 And Powsińska 61/63 In Warsaw, Within The Meaning Of The Act Of April 10, 1997, Energy Law (Consolidated Text, Journal Of Laws Of 2026, Item 43) [Hereinafter Energy Law] And The Implementing Acts Issued On Its Basis. The Subject Of The Order Is Described In Detail In The Description Of The Subject Of The Order Constituting Chapter Iii Of The Swz. 2. The Ordering Party Envisages Granting The Option Right. The Ordering Party Provides For The Right Of Option In The Proceedings In Question. A) The Ordering Party Provides For The Possibility Of Increasing The Supply Of Electricity Or Increasing The Maximum Value Of The Agreement Using The Option Right; B) The Option Right Amounts To A Maximum Of 20% Of The Amount Specified In §8 Section 7 Draft Provisions Of The Agreement. C) The Ordering Party Makes The Exercise Of The Option Right Conditional On: 1) Adding New Energy Consumption Points (Hereinafter Referred To As Ppe) Or 2) Increasing The Demand For The Supply Of Electricity In The Existing Ppe Or 3) Increasing The Costs Of Contract Implementation Related To The Supply Or Distribution Of Energy. D) The Settlement Of The Increase In The Demand For Electricity Supply At The Ppe And/Or Additional Collection Points Will Be Made According To The Basic Part Of The Order And According To The Same Settlement Rate. E) The Ordering Party Is Not Obliged To Exercise The Option Right. F) If The Ordering Party Does Not Exercise The Option Right, The Contractor Shall Not Be Entitled To Any Claims In This Respect. G) The Condition For Triggering The Option Right Is The Ordering Partys Declaration Of Will To Execute The Order Under The Option Right And Submitting An Appropriate Written Order Specifying The Scope/Value Of The Granted Option Right.
