The Subject Of The Order Has Not Been Divided Into Parts. The Ordering Party Does Not Allow The Submission Of Partial Offers. 3. Identification Of The Subject Of The Contract Using Cpv Codes: - 09135100-5 - Heating Oil 4. The Ordering Party Envisages The Use Of The So-Called Reverse Procedure Referred To In Art. 139 Of The Public Procurement Law, I.E. The Ordering Party Will First Examine And Evaluate The Offers, And Then Subjectively Qualify The Contractor Whose Offer Was Rated The Highest In Terms Of The Lack Of Grounds For Exclusion And Compliance With The Conditions For Participation In The Procedure. 5. The Ordering Party Pursuant To Art. 441 Of The Public Procurement Law Provides For The Application Of The Option Right By Submitting A Unilateral Written Declaration Containing The Quantities Of Fuel Oil To Be Delivered Under The Option Right. A Declaration Of Exercise Of The Option Right May Be Made No Later Than 5 Days Before The Expiry Of The Contract. The Option Right Consists In Increasing The Amount Of Heating Oil Ordered Under The Contract To A Maximum Of 30% Of The Contractors Remuneration Specified In The Contract In Force On The Day Of Submitting The Declaration On Exercising The Option Right. The Right Referred To In The Preceding Sentence May Be Exercised Multiple Times Until It Reaches 30% Of The Contractors Remuneration On The Date Of Submitting The Declaration. Exercising The Option Right Increases The Contractors Maximum Remuneration Specified In The Contract. If The Option Right Is Exercised, The Provisions Of The Contract Regarding Prices Apply Directly To The Increased Scope Of The Order. The Condition For Exercising The Option Right Is The Proper Performance Of The Subject Matter Of This Contract By The Contractor. The Contractor Is Not Entitled To Any Claim Due To The Ordering Partys Failure To Exercise The Option Right. 6. Due To The Fact That The Amount Of Fuel Oil Depends On The Current Needs Of The Ordering Party, The Ordering Party Stipulates That The Quantity Of Ordered Fuels Given In Annex No. 1 To The Swz Is An Estimated Quantity Which Is Used For The Correct Evaluation Of Offers According To The Price Criterion Of 100%. This Quantity May Change - In Accordance With The Actual Needs Of The Ordering Party And Will Not Be The Subject Of Any Claims From The Contractor. The Ordering Party Guarantees That The Minimum Value Of The Order Awarded To The Contractor Will Be 60% Of The Total Remuneration Specified In The Contract.
