The Subject Of The Basic Order Is The Purchase (Renewal Of Subscriptions Currently Held By The Ordering Party In The Quantities Described In Table No. 2 Of The Description Of The Subject Of The Order) Of A Subscription For The Use Of Red Hat Software (Based On Open Source Solutions) Along With Manufacturers Support, In Accordance With The Manufacturers Current Licensing Model. Detailed Description Of The Subject Of The Order, List Of Tasks, Deadlines And Terms Of Execution Of The Subject Of The Order, Payment, Etc. Are Specified In The Draft Provisions Of The Agreement (Hereinafter: Ppu), Which Constitute Appendix No. 2 To The Swz And The Description Of The Subject Of The Order (Hereinafter: Opz), Which Constitutes Appendix No. 1 To The Swz. The Ordering Party Appropriately Divided The Subject Of The Contract Into A Basic Contract And An Order Covered By Option Rights. The Ordering Party Provides For The Possibility Of Exercising The Option Right To Purchase Additional New Red Hat Software Subscriptions (On The Basis Of Open Source Solutions) Along With Manufacturers Support. The List Of Software Subscriptions That Can Be Purchased By The Ordering Party In The Optional Part Of The Order Is Provided In Table No. 3 Of The Description Of The Subject Of The Order. Detailed Information Regarding The Option, Including The Scope, Deadline For Exercising This Right By The Ordering Party And The Rules On Which The Option Will Be Exercised, Are Included In The Ppu. The Ordering Party Informs That The Option Right Is The Ordering Partys Right, Which It May, But Does Not Have To, Exercise Under This Order. The Exercise Of The Option Right, In Whole Or In Part, Is Reserved At The Sole Discretion Of The Ordering Party. If The Ordering Party Fails To Exercise The Option Right In Whole Or In Part, The Contractor Will Not Be Entitled To Additional Remuneration Or Any Claim. Note: The Trademarks, Patents And Place Of Origin Indicated In This Swz And The Annexes To The Swz Are Justified By The Specific Nature Of The Subject Of The Contract - They Refer To The Description Of The Software Operating Within The Ordering Partys Existing Ict Infrastructure And Its Expansion. Whenever The Content Of The Swz, Including The Description Of The Subject Of The Order, Uses Trademarks, Patents Or Origins, Sources Or Specific Processes, As Well As Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, The Ordering Party Allows A Solution Equivalent To The One Described. A Product Equivalent To The Specified Subject Of The Order Is Understood As A Product With The Parameters And Minimum Requirements Specified (Mentioned) And Specified In Detail In The Opz. The Ordering Party Allows The Submission Of Equivalent Offers, And All Goods Specified In The Documentation, From Specific Manufacturers, Specify The Minimum Quality Parameters And Functional Features That The Goods Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only A Quality Standard Of The Subject Of The Order.
