Miscellaneous Food Products – Deliveries Of Food Products To Rzgw Gliwice. 4.1 The Subject Of The Order Is The Supply Of Food Products For Rzgw Gliwice And Its Subordinate Units. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 2 To The Swz And Annex No. 5 To The Swz. 4.2. The Ordering Party Pursuant To Art. 441 Of The Public Procurement Law Provides For The Application Of Option Law. 4.2.1. The Option Right Will Consist In: • Execution Of Deliveries In Accordance With The Agreement At The Prices Specified In The Contractors Offer, After The End Of The Original Implementation Period Of The Agreement (12 Months) For A Period Not Longer Than 12 Months, • Increasing The Scope Of The Contractual Obligation, I.E. Additional Execution Of Deliveries To The Extent Indicated In The Offer Form, At Prices Specified In The Contractors Offer, Which Will Not Exceed 20% Of The Maximum Value Of The Contract Under The Basic Order Referred To In § 1 Section 4 Agreements. 4.1.2. The Ordering Party May Exercise Both Variants Of The Option Right Together Or Each Separately At Its Own Discretion. The Total Value Of Exercising The Option Right, Regardless Of The Number And Type Of Option Variants Used, Will Not Exceed 220% Of The Maximum Value Of The Contract Under The Basic Order Referred To In § 1 Section 4 Agreements. 4.1.3. In Order To Exercise The Option Right Referred To In Section 2 Point 1 Of The Agreement, The Ordering Party Will Provide The Contractor With A Declaration In Writing No Less Than 10 Days Before The End Of The Basic Deadline, Indicating The Period By Which The Deadline For Execution Of The Agreement Will Be Extended. 4.1.4. In Order To Exercise The Option Right Referred To In Section 2 Point 2 Of The Agreement, The Ordering Party Will Provide The Contractor With A Written Declaration, Within The Validity Period Of The Agreement (Basic Term And Option Term), About The Need To Provide Additional Deliveries Under The Option Right. 4.1.5. The Contractor, After Receiving The Information Referred To In Section 4 And/Or Section 5 Of The Agreement Will Be Obliged To Provide Deliveries On The Terms Specified In The Agreement, In Particular Using The Unit Prices Specified In The Assortment And Price Form. 4.1.6. The Ordering Party Reserves That The Part Of The Order Defined As An Option Right Is An Entitlement And Not An Obligation Of The Ordering Party. The Option May, But Does Not Have To, Be Exercised Solely Depending On The Needs And Financial Capabilities Of The Ordering Party And As A Result Of Its Instructions In This Regard. Failure To Complete The Order In This Respect Will Not Give Rise To Any Claims On The Part Of The Contractor Against The Ordering Party.
