The Subject Of The Order Is The Supply Of Electricity Within The Meaning Of The Act Of April 10, 1997, Energy Law (Consolidated Text: Journal Of Laws 2026.43), Hereinafter Referred To As The Supply Of Active Electricity, In The Estimated Total Amount, During The Term Of The Contract, Of Approx. 6,175.00 Mwh. 2. The Contractor, At The Latest On The Day Of Commencement Of The Order Execution And On The Day Of Signing The Contract, Should Have Concluded Contracts Or Promise Of Contracts For The Provision Of Electricity Distribution Services With The Distribution System Operators: Pge Dystrybucja S.A., Pkp Energetyka Spółka Akcyjna, Esv6 Sp. Z O. O., Stoen Operator Sp. Z O. O. And Energa Operator S.A. The Contractors Declaration That It Has A Current Contract Or Promise Of A Contract With The Relevant Distribution System Operator (Dso) Enabling The Sale Of Electricity Through The Dsos Distribution Network To The Ordering Partys Facilities Will Be A Condition For Signing The Public Procurement Contract. 3. The Ordering Party Reserves The Right To Reduce The Number Of Energy Consumption Points Indicated In Annex 1A To The Swz In The Event Of Changes In The Ownership Of Administration Rights, Changes In The Method Of Use Or Closure Of Individual Energy Consumption Points. 4. The Ordering Party, In Accordance With Art. 441 Of The Act Provides For The Possibility Of Applying The Option Right. If, During The Execution Of The Contract, It Turns Out That New Electricity Consumption Points Will Be Created Not Indicated In This Tor, The Ordering Party Reserves The Right To Exercise The Option And Order The Supply Of Electricity To These New Points At The Prices Specified By The Contractor In Its Offer. The Supply Of Electricity Covered By The Option Right May Not Exceed 15% Of The Basic Scope Of The Subject Of The Order. 5. The Sale Of Electricity Should Be Consistent With The Provisions Of The Energy Law And Its Implementing Regulations. 6. A Detailed Description Of The Scope Of The Subject Of The Contract Is Included In The Annexes To The Swz. 7. The Ordering Party Does Not Envisage Awarding Contracts Referred To In Art. 214 Section 1 Point 8 Of The Public Procurement Law, I.E. Consisting In The Repetition Of Similar Deliveries Constituting This Basic Order.
