A Detailed Description Of The Equipment, Its Quantity And The Place To Which It Should Be Delivered Is Included In The Price Form, Which Is An Annex To The Swz. The Ordering Party Requires That The Offered Assortment Constituting The Subject Of This Order Is: A) High-Quality Products That Meet Applicable Standards And The Ordering Partys Requirements; B) Brand New, Never Used Before, Not Affected By Any Physical Defect, Free From Third-Party Rights, C) Packed In Packaging Enabling Unambiguous Identification Of The Product, D) Complete And Ready For Use, E) Compliant With Safety Standards (It Had A Ce Declaration) And Had The Legally Required Approvals And Certificates, As Well As The Necessary Instructions And Materials For Use In Polish. If The Swz Uses Trademarks, Patents Or Origin, Source Or Individual Process That Characterizes The Products Delivered By A Specific Contractor - This Means That They Were Provided As Examples And Specify Only The Minimum Expected Quality Parameters And The Required Standard. Offers With Equivalent Operational, Functional And Quality Parameters May Be Submitted, Provided That They Ensure Compliance Of The Subject Of The Contract With The Swz. It Is The Contractors Responsibility To Prove That The Offered Replacement Meets The Terms Of The Order In Terms Of Equivalence. The Contractors Offer Price Must Include All Costs Related To The Execution Of The Subject Of The Order, In Particular The Costs Of Delivery, Loading, Unloading And Assembly In Designated Rooms. The Cost Of Delivery Should Be Included In The Unit Prices Of The Delivered Products And Should Not Be A Separate Item On The Invoice/Bill. Detailed Terms Of Delivery, Warranty, Method Of Payment For The Delivered Equipment And Obligations Of The Parties Are Included In The Contract Template Attached To The Swz.
