The Subject Of The Order Is The Design, Delivery And Assembly Of Photovoltaic Installations With A Total Capacity Of Min. 165.545 Kwp For The Following Facilities: 3.1.1. Sewage Treatment Plant In Sierakowice (Ul. Leśna, 44-156 Sierakowice); 3.1.2. Sewage Treatment Plant In Trachy (Ul. Raciborska 78, 44-153 Trachy); 3.1.3. Water Treatment Plant In Rachowice (Ul. Do Groty, 44-156 Rachowice); 3.1.4. Water Treatment Plant In Sierakowice (Ul. Kozielska, 44-156 Sierakowice); 3.1.5. Water Treatment Plant In Sośnicowice (Ul. Św. Jakuba, 44-153 Sośnicowice). 3.2. The Order Includes Services (Design Works), Supplies (Delivery Of Equipment) And Construction Works (Assembly Works), With The Main Service In The Actual Situation Being Deliveries. 3.5. The List Of Materials In The Functional And Utility Program Has Only An Auxiliary Function And Is Not Binding When Pricing The Order. 3.6. If The Procurement Documents Indicate Trademarks, Patents, Origin, Sources Or Specific Processes Characterizing Products, Materials, Solutions Or Services Provided By A Specific Contractor, Manufacturer, Or Standards, As Well As Other References Referred To In Art. 101 Section 1 Point 2 Or Section 3 Of The Act, They Should Be Treated As Examples, While The Ordering Party Allows Offering Materials Or Equivalent Solutions. Materials, Devices Or Solutions With Parameters Not Worse Than Those Required Are Considered Equivalent, And If Minimum Parameters Have Not Been Specified, It Should Be Understood As Materials, Devices Or Solutions With Similar Parameters, Suitable For The Required Application, Including In Terms Of Identity Of Function, Type And Quality Of Materials And Technical Data. 3.7. The Ordering Party Does Not Allow The Submission Of Partial Offers For The Reasons Specified Below. This Contract Is Awarded In Parts, Each Of Which Is The Subject Of A Separate Procurement Procedure. Each Part Is Characterized By A Comprehensive Scope Of Execution In The Design And Build Formula. Allowing The Submission Of Partial Offers Would Pose The Risk Of Excessive Technical And Organizational Difficulties Resulting From The Dispersion Of The Contractors Responsibility For Both Its Performance And After-Sales Service (Warranty And Service). It Could Also Lead To Significant Differences In The Standard And Quality Of Services, Supplies And Construction Works At Various Facilities Of The Ordering Party. It Should Also Be Taken Into Account That The Contract In Question Is Characterized By A Certain Degree Of Repeatability, Which Facilitates Its Execution And Allows For Reducing Costs If It Is Not Excessively Diversified. Allowing The Submission Of Partial Tenders Would Not Have An Impact On Increasing Competitiveness (Including Increasing Accessibility For The Sme Sector), Because It Is A Small-Scale Contract That Can Be Performed By The Same Group Of Contractors From The Sme Sector As The Individual Elements Of The Contract.
