Tenders are invited for Renovation of a War-Damaged School in the Village of Ivankiv, Kyiv Region, into an Innovative Building with Nearly Zero Energy Consumption. This Invitation for Tenders follows the General Procurement Notice dated 11.07.2024 for the Project Nearly Zero Energy Renovations of School Buildings (hereinafter the Project), which was published on the Procurement Notices section of NEFCOs website (https://www.nefco.int). Department of Education of the Ivankiv Village Council, Vyshhorod District, Kyiv Region, hereinafter referred to as the Employer, intends to apply part of the proceeds of a grant from the Nordic Environment Finance Corporation (NEFCO), acting as Implementing Agency of the E5P Fund, toward eligible payments under the contract Renovation of a war-damaged school in the village of Ivankiv, Kyiv region, into an innovative building with nearly zero energy consumption. The Project is financed by a grant administered by NEFCO and funded by the Eastern Europe Energy Efficiency and Environment Partnership Fund (the "E5P Fund"), established by the European Bank for Reconstruction and Development ("EBRD") within the framework of the Eastern Europe Energy Efficiency and Environment Partnership. The Employer now invites tenders from Contractors for the following contract Nearly Zero-Energy Renovation of the of Ivankiv Lyceum No. 1 of the Ivankiv Village Council, Vyshhorod District, Kyiv Region, TD # E5P17-2025-161/ IVNKV-NZ-G1 financed by the E5P grant. Tenders and subsequent contracts financed by the grant shall be subject to NEFCOs Procurement Policy and Procedures. Grant funds may not be used for any payments to individuals or entities, or for the import of any goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Charter of the United Nations, or under the laws or official regulations of Ukraine. Based on the results of the Tender, the Employer shall sign contract TD # E5P17-2025-161/ IVNKV-NZ-G1 with the Tenderer, that submits the most economically attractive tender and meets all qualification requirements. Tenders shall be submitted in euro Contract TD # E5P17-2025-161/ IVNKV-NZ-G1 financed by the EBRD grant shall be concluded in euro and shall be subject to the tax exemption procedure in accordance with Resolution of the Cabinet of Ministers of Ukraine dated 15.02.2002 No. 153 To be qualified for the award of the contract, tenderers shall satisfy the following minimum criteria: Tenderers shall meet the eligibility requirements outlined in the Instructions to Tenderers. The Average Annual Turnover of the Tenderer over the last four (4) years (2022-2025) exceeded EUR 5,000,000 equivalent. In case of tender submitted by the JVCA, all members/partners of the JVCA shall cumulatively demonstrate 100% compliance with the requirements, while the leading member/partner shall demonstrate at least 50% compliance with the requirement, which means to demonstrate Average Annual Turnover over the last four (4) years (2022-2025) exceeded EUR 2,500,000. The Tenderer has satisfactorily supplied and completed for the period 2020-2025: o five (5) contracts, each for new construction/reconstruction/capital repair of buildings, with a cumulative total amount of at least EUR 5,000,000, as the main Contractor or a Contractor, which have been fully and successfully completed and include a comprehensive scope of works on energy-efficient modernization, including the implementation of green technologies, internal engineering systems, etc. o In case the Tender is submitted by the JVCA, all members/partners of the JVCA shall cumulatively demonstrate 100% compliance with the requirements, while the leading member/partner shall demonstrate three (3) contracts, each for new construction/reconstruction/capital repair of buildings, with a cumulative total amount of at least EUR 2,500,000, as the main Contractor or a Contractor, which have been fully and successfully completed and include a comprehensive scope of works on energy-efficient modernization, including the implementation of green technologies, internal engineering networks, etc. Non-performance of contract by the Tenderer (including partners/members of JVCA if appropriate) did not occur during the last 4 years (2022-2025) based on information provided in Section III, Tender Forms (the Employer reserves the right to check the correctness of the reported information by using other sources); All pending litigations against the Tenderer (including members/partners, if the Tenderer is a JVCA) shall in total not represent more than thirty (30) percent of the Tenderers net worth, The Tenderer (whether a single legal entity, a JVCA partner or a designated subcontractor) shall demonstrate availability of all personnel for the implementation of all necessary works under the Contract; The Tenderer shall demonstrate that it has the personnel for the key positions that meet the Qualification requirements outlined in the Tender document. The Employer reserves the right to cancel all tenders in the event of non-approval of grant funding. When preparing their tenders, Tenderers shall take into account that the works under this Contract are expected to commence in September 2026 and must be completed no later than January 2028.
