The Subject Of The Order Is The Supply In The Form Of Operating Leasing Of A Climatic Chamber (Hereinafter Referred To As The Climatic Chamber) For The Central Mining Institute - National Research Institute. The Ordering Party Requires That The Device Meets The Requirements Described In Annex 5 To The Swz. The Subject Of The Order Will Be Collected In Mikołów At The Barbara Experimental Mine, Ul. Podleska 72. The Contractor Will Be Obliged To: 1) Conclude An Operational Leasing Agreement For A Period Of 36 Months; 2) Present A Valid Offer For 35 Monthly Leasing Installments Payable In Accordance With The Payment Schedule, Taking Into Account An Initial Fee Of 0% Of The Gross Value Of The Chamber And The Buy-Out Amount Of The Climatic Chamber In The Amount Of 1% Of The Gross Value; In A Contract Lasting 36 Months, The Ordering Party Will Therefore Pay 35 Installments, Due To The Fact That The Payment Deadline For The First Installment Falls One Month After Receipt Of The Device. The Purchase Fee (Guarantee Deposit) Is Paid Together With The Last Installment;3) Training Of The Ordering Partys Staff In The Operation Of The Climatic Chamber;4) Property Insurance For The Entire Leasing Period;5) The Ordering Party Requires That The Leasing Installment Includes: - Costs Related To Warranty Service.6) The Leasing Installment Will Not Include - Costs Related To Post-Warranty Service - Costs Related To Calibration Of The Chamber In Pca. - Costs Of Materials Consumables2. The Contractor Provides: 1) Free Training, Within 3 Business Days From The Date Of Delivery Of The Climatic Chamber, For Future Users In The Operation And Maintenance Of The Supplied Equipment; 2) A Guarantee That The Climatic Chamber Being The Subject Of The Order Is Free From Construction, Material, Workmanship And Legal Defects, Brand New From 2026; 3) On The Day Of Receipt Of The Equipment In Question, The Supplier Will Provide The Ordering Party With Documents Specifying The Conditions Of Servicing, Operating Instructions, And Technical Inspection. 3. If The Contractor Finds That The National Standards, European Standards Or International Standards Used In The Swz And In The Annexes To The Swz May Indicate The Producers Of The Products Or Their Sources Of Origin, The Ordering Party Allows Equivalent Solutions In This Respect. This Means That The Technical Parameters Of The Products Indicated In This Way Determine The Minimum Expectations Required By The Ordering Party As To The Quality Of The Products To Be Used To Perform The Subject Of The Contract. Moreover, In Each Case It Is Found That The Description Or Feature Of The Described Product, Which May Indicate The Source Of Origin Or Manufacturer, The Contractor Is Also Entitled To Use Equivalent Products, Which Means Those With Technical Parameters Not Worse Than Those Indicated In The Swz And/Or In The Annexes To The Swz. It Is Also Allowed To Demonstrate This Equivalence With Standards Equivalent To Those Indicated In The Opz
