Pursuant To Art. 182, Para. 1, Item 5 Of The Public Procurement Act, The Contracting Authority May Conduct Direct Negotiations With Certain Persons When The Public Procurement Is For Services Under Annex No. 2 And Has A Value Under Art. 20, Para. 2, Item 2 Of The Civil Code. In The Present Case, The Contracting Authority Has The Legal Possibility To Choose A Contractor For The Specified Public Procurement Through Direct Negotiation With Certain Persons, Since The Public Procurement Is For A Service Under Annex No. 2 And Has A Value Under Art. 20, Para. 2, Item 2 Of The Civil Code. For This, The Contracting Authority Proceeds To Direct Negotiations With Certain Persons For The Award Of The Public Contract. According To Appendix No. 1 To Art. 4 Of Ordinance No. H-1 Of 23.07.2024 For Product Group: Food, Catering Services And Vending Machines For Food And Beverages - Food Delivery), The Contracting Authority Is Legally Obliged In 2025 And 2026 To Apply The Requirement For The Delivery Of Organic Food Products For No Less Than 4% For 2026 Of The Total Amount Of The Delivery Of The Group Foods, According To The List Of Organic Food Products From The Above Regulation.
