A Detailed Description Of The Subject Of The Order Is Specified In: 1) Bill Of Quantities - Annex No. 4 To The Swz, 2) Technical Specifications - Annex No. 5 To The Swz, 3) Other Technical Documentation - Annexes No. 6 - 9 To The Swz.3. The Ordering Party Requires That Manual Workers Assigned By The Contractor Or Subcontractor To Perform The Following Activities: Construction Works Falling Within The Scope Of The Subject Of The Contract, Are Employed On The Basis Of An Employment Relationship.4. The Ordering Party, In Accordance With The Provisions Of Art. 99 Section 5 And Art. 101 Section 4 Of The Act, Allows Equivalent Solutions For Works, Materials And Systems That Meet Applicable Standards And Requirements. The Ordering Party Reserves That Wherever Trademarks, Patents Or The Origin Of Devices Or Materials Are Indicated In The Description Of The Subject Matter Of The Contract, They Should Be Treated Solely As The Designers Proposals. The Ordering Party Allows Methods, Materials, Devices, Systems, Technologies, Etc. Equivalent To Those Presented In The Description Of The Subject Of The Order. Therefore, It Is Allowed To Propose In The Offer Any Equivalent Market Equivalents With Properties Not Worse Than Those Indicated By The Ordering Party. The Parameters Of The Indicated Standard Define The Minimum Technical, Operational, Utility, Quality And Functional Conditions To Be Met By The Subject Of The Order. The Offer May Include Methods, Materials, Devices, Systems, Technologies, Etc. From Other Brands And Manufacturers, But With Technical, Quality Parameters And Performance And Functional Properties Corresponding To The Methods, Materials, Devices, Systems, Technologies, Etc. Described In The Swz. In Addition, Replacement Devices Accepted For Valuation: Should Fulfill The Function They Are Intended To Serve, Should Be Compatible With Other Devices So That The Set Of Devices Gives The Intended Effect, Cannot Change The Type And Scope Of Construction Works. At The Request Of The Ordering Party, The Contractor Is Obliged To Prove That The Applied Equivalent Solutions Will Allow To Achieve All Technical Assumptions For The Investment Task In Question, Taking Into Account The Entire Investment, And Not A Selected Fragment Of The Whole. The Burden Of Proving That The Material Or Device Is Equivalent To The Requirement Specified By The Ordering Party Rests With The Contractor. If The Materials And/Or Equipment Offered By The Contractor As Equivalent Are Not Equivalent In The Light Of The Documents Submitted By The Contractor, The Contractors Offer Will Be Rejected As Not Corresponding To The Content Of The Swz.
