1. The Subject Of The Order Is Modernization Of The Entrance Façade Of The Lintel Of The Building At Ul. Augustyńskiego 1 In Gdańsk Along With Drying Part Of The Basement Of The Building.2. The Task Will Be Performed On The Basis Of The Construction Design Modernization Of The Main Entrance Facade With Reconstruction Of The Insulation Of The Underground Walls For The Building At Ul. Augustyńskiego 1 In Gdańsk By Abp Architektoniczne Biuro Projektów Roman Wyrzykowski, Constituting Annex No. 1.2 To Swz.3. The Description Of The Subject Of The Contract Is Specified In: • Description Of The Subject Of The Contract, Which Constitutes Annex No. 1.1 To The Swz;• Construction Projections, Which Constitutes Annex No. 1.2 To The Swz;• Draft Contract, Which Constitutes Annex No. 2 To The Swz.4. The Contractor May Not Use Errors Or Omissions Contained In The Indicated Documentation, And Should Immediately Notify The Ordering Party Of Their Detection, Who Will Make Appropriate Corrections Or Changes. The Data Specified In The Attached Documentation Are Considered Target Values, Changes In Which Are Permissible As Part Of The Arrangements With The Ordering Party.5. The Contractor Is Obliged To Verify The Provided Solutions, And In The Event Of Discrepancies In The Designed Solutions, The Contractor Will Not Claim Any Rights To Additional Remuneration.6. The Contractor Is Obliged To Take Into Account In The Valuation And Offer Supplies And Additional Costs That May Occur During Construction Works In Old Facilities - Such As The One Being The Subject Of This Investment.7. The Contractor Is Obliged To Analyze The Solutions Presented In The Tender Documentation In Terms Of The Adopted Technical Solutions And System Optimization.8. The Law Applicable To This Order (Including The Contract Concluded As A Result Of These Proceedings And For The Assessment Of The Legal Effects Of All Documents In This Order) Is Polish Law, Taking Into Account European Union Law.9. In All Provisions Of The Swz And Its Annexes In Which The Ordering Party Refers To Standards, Approvals, Technical Specifications Or Reference Systems Or Indicates Trademarks, Parameters Or Sources Of Origin (Names Of Manufacturers Or Devices), In Accordance With Art. 99 Section 5 And Art. 101 Section 4 Of The Public Procurement Law, The Ordering Party Allows Equivalent Solutions.10. If The Annexes Constituting The Description Of The Subject Of The Order Include The Names Of Materials And Products Of Specific Manufacturers, This Should Be Treated Only As A Definition Of The Desired Standard And Quality. In All Such Situations, The Contractor May Offer Equivalent Materials And Products With At Least The Same Technical And Quality Parameters. Product Equivalence Means Offering A Product Whose Technical Parameters Of The Materials Used, Efficiency, Durability And Quality Are Not Inferior To The Quality Of The Materials And Products Described In Swz.11.
