Tenders Are Invited For Delivery Of A Brand New Backhoe Loader For The Świlcza Commune

1. The Subject Of The Order Is The Purchase Of A Brand New Backhoe Loader That Meets The Stage V Exhaust Emission Standard In Accordance With The Requirements And On The Terms Indicated In The Detailed Description Of The Subject Of The Order Constituting Annex No. 4 To The Swz, And Its Delivery To The Indicated Place In The Świlcza Commune. 2. The Delivered Backhoe Loader Must: 1) Be Brand New, Undamaged, Free From Physical Defects (Design, Material, Workmanship And Technical), Complete, Manufactured No Earlier Than 2026, Fully Technically Operational, Capable Of Proper Operation In Accordance With The Functional Scope And Intended Use; 2) Constitute The Exclusive Property Of The Contractor And Be Free From The Rights And Claims Of Third Parties; 3) Have Valid Certificates, Approvals, Certificates, In Accordance With Applicable Standards And Legal Regulations.3. Together With The Offer, The Contractor Submits A Completed Table - Annex No. 4 To The Swz, Which Constitutes Part Of The Offer And Is Not Subject To Supplementation In Accordance With The Public Procurement Law. 4. The Subject Of The Order Also Includes Training Of The Ordering Partys Representatives In The Operation Of The Vehicle And Equipment. In Addition, The Contractor Is Obliged To Conduct Additional Training For Backhoe Loader Operators In The Field Of Sustainable Resource Management, Operation And Work Techniques That Minimize The Environmental Effects Of Using The Machine, And Rules Of Conduct In The Event Of Leaks Of Operating Substances And Other Events That May Cause Environmental Pollution, As Well As Rules For Using And Operating The Vehicle In A Sustainable Manner, Taking Into Account Lower Fuel Consumption And Minimizing Greenhouse Gas Emissions.5. Detailed Conditions For The Implementation Of The Subject Of The Order Are Specified In The Contract Template Constituting Annex No. 3 To This Tor.6. All Requirements Specified In The Documents Indicated Above Are Minimum Requirements And Their Fulfillment Is Obligatory. Failure To Meet The Above-Mentioned Minimum Requirements Will Result In Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Section 1 Point 5 Of The Pzp.7 Act.
