The Subject Of The Order Is The Development Of Design And Cost Estimate Documentation And The Performance Of Construction Works Including The Construction Of Three Sections Of The Sanitary Sewage System On Plots No. 162/1, 162/2, 161, 94/2, 94/1, 319/5 In The City. Andruszkowice And On Plots No. 28/4, 29/1, 30/2 In The Month. Złota, In The Design And Build System.2. The Subject Of The Order Includes In Particular: 1) Development Of Technical Documentation, Along With Obtaining All Legally Required Decisions, Arrangements, Opinions, Permits, And Technical Conditions, 2) Performance Of Construction Works Based On The Design Documentation, Along With Obtaining An Occupancy Permit Or Reporting The Completion Of Construction Works, 3) Conducting Authors Supervision Over The Implementation Of Construction Works Based On The Documentation To The Extent Resulting From The Construction Law. A Detailed Description Of The Subject Of The Order Includes: Functional And Utility Program, Which Constitutes Annex No. 10 To Swz.2. The Ordering Party Has Made Every Effort To Ensure That The Documentation Does Not Contain Any Reference To Any Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor. If, Despite Verification Of The Documentation, Such A Marking Remains In The Content Or On The Drawing, They Should Be Treated As Reference Products That Can Be Replaced By Others With Equivalent Parameters, Even If The Term Or Equivalent Is Not Used. Any Trade Names Used In The Design Documentation Would Constitute A Definition Of A Standard Or A Product Type, And Not As A Request For Contractors To Offer Materials And Devices Offered By Specific Manufacturers. Equivalent Materials And Devices Will Be Those That Have No Worse Or Better Features Or Parameters And Perform Similar Functions Or Are Made Of Materials With Similar Characteristics, Durability And Strength. Equivalence Will Be Assessed On The Basis Of Product Data Sheets Or Standards Met By A Given Device Or Product.3. If The Contractor Finds That The Parameters Or National Standards Or Standards Used In The Swz And In The Annex To The Swz, Or Those Translating Into European Or International Standards, May Indicate The Producers Of The Products Or Their Sources Of Origin, This Means That They Are Of Such Importance That The Technical Parameters Of The Products So Indicated Determine The Minimum Expectations Required By The Ordering Party As To The Quality Of The Products To Be Used To Perform The Subject Of The Contract. The Contractor Is Entitled To Use Equivalent Products, Which Means Those With Technical Parameters Not Worse Than Those Indicated In The Standards Used In The Swz And In The Annexes To The Swz. It Is Also Allowed To Demonstrate Equivalence With Standards Equivalent To Those Indicated In The Documentation And Stwior And By Using Materials Corresponding To A Given Standard.
