1. The Subject Of The Order Is The Ongoing Maintenance Of Traffic Lights And Technological Channels In The City Of Suwałki.2. Pursuant To Art. 101 Section 4 Of The Public Procurement Law In A Situation Where The Documents Describing The Subject Of The Contract Include References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Section 1 Point 2 And Section 3 Of The Public Procurement Law And Such References Were Not Accompanied By The Expression Or Equivalent, The Ordering Party Allows Solutions Equivalent To Those Described In Each Such Standard, European Technical Assessment, Approval, Technical Specification, Technical Reference System. Due To The Above, It Should Be Assumed That Each Standard, European Technical Assessment, Approval, Technical Specification, Technical Reference System Appearing In The Description Of The Subject Of The Contract Is Accompanied By The Words Or Equivalent.3. Pursuant To Art. 101 Section 5 Of The Public Procurement Law, A Contractor Who Refers To Solutions Equivalent To Those Described In These Documents Is Obliged To Prove, By Attaching To The Offer, Appropriate Evidence Referred To In Art. 104-107 Of The Public Procurement Law, That The Proposed Solutions Equally Meet The Requirements Specified In The Description Of The Subject Of The Contract.4. If The Description Of The Subject Of The Order Indicates, In Relation To Certain Materials Or Devices, Trademarks, Patents Or Origin, Sources Or A Specific Process That Characterizes The Product, It Means That They Are Given As Examples And Mean The Minimum Expected Quality Parameters And The Required Standard.5. The Ordering Party Will Consider Equivalent Materials Or Devices To Be Those Whose Quality And Performance Parameters Are At Least At The Level Of The Parameters Specified In The Description Of The Subject Of The Order Or Better.6. A Detailed Description Of The Subject Of The Order, The Scope Of The Order And The Scope Of The Contractors Responsibilities Were Specified In The Price Form - In Annex No. 2 To The Swz, In Annex No. 8 To The Swz - Contract Template, In Annex No. 9 To The Swz And In Annex No. 10 To The Swz - List Of Intersections With Traffic Lights And Active Crossings.
