1. The Subject Of The Order Is: Reconstruction And Change Of Use Of The Cloakroom Into A Technical Room In The Building Of The District Hospital. A. Wolańczyka Sp. Z O. O. In Złotoryja - Construction Of A New Main Rg Switchboard Along With Adaptation Of The Rooms To The Function Of A Lv-0.4Kv Switchboard And Renovation Of The Adjacent Corridor. A Detailed Description Of The Subject Of The Order Includes: 1) Description Of The Subject Of The Order - Annex No. 2 To The Swz, 2) Design Documentation - Annex No. 3 To The Swz.3. The Ordering Party Does Not Allow The Submission Of Partial Offers. Each Contractor May Submit Only One Offer For The Entire Order. If The Contractor Submits More Than One Offer For The Entire Order, All Offers Of This Contractor Will Be Rejected By The Ordering Party. If The Contractor Submits An Offer For Single Items, The Contractors Offer Will Be Rejected By The Ordering Party. Justification: The Subject Of The Order Is Limited In Location And Scope. There Is No Logical Or Substantive Possibility Of Dividing The Subject Of The Contract Into Parts. Moreover, The Execution Of Part Of The Order Without The Execution Of The Remaining Parts Does Not Meet The Needs Of The Ordering Party And The Failure To Perform A Given Part Of The Order Prevents The Execution Of The Remaining Parts. The Subject Of The Order Constitutes An Inseparable Whole And Dividing This Order Into Parts For Technical And Organizational Reasons Would Cause Excessive Difficulties In Its Implementation - The Order Constitutes One Whole Due To Its Technical Specificity. The Value Of The Order Is Lower Than The So-Called Eu Thresholds That Oblige To Implement Eu Directives. Directive 2014/24/Eu States In Recital 78 That, In Order To Increase Competition, Contracting Authorities Should In Particular Be Encouraged To Divide Large Contracts Into Lots. The Contract In Question Is Not A Large Contract Within The Meaning Of Recital 78 Of The Above-Mentioned Eu Directive (The Directives Apply From The So-Called Eu Thresholds, And The Directive Uses The Concept Of A Large Contract In The Context Of Contracts Subject To The Directive, I.E. A Contract With A Value Significantly Exceeding The So-Called Eu Thresholds). The Ordering Party Did Not Divide The Contract Into Parts Due To The Fact That Such A Division Would Pose A Risk Of Excessive Technical Difficulties And Excessive Costs Of Contract Execution. The Need To Coordinate The Activities Of Various Contractors Implementing Individual Parts Of The Contract Could Seriously Jeopardize The Proper Execution Of The Contract. Therefore, The Failure To Divide The Contract Was Dictated By Technical And Organizational Reasons And The Nature Of The Subject Of The Contract. Any Division Of The Order Into Lots Would Not Increase Competitiveness In The Small And Medium-Sized Enterprises Sector - The Scope Of The Order Is Typical, Enabling Contractors From The Group Of Small And Medium-Sized Enterprises To Submit An Offer.
