Law 19/2010, Of December 22, On Financial Measures And Creation Of The Public Entity Institute For Business Competitiveness Of Castilla Y León (Icecyl), And Decree 67/2011, Of December 15, Approving Its General Regulations, Attribute To Icecyl Its Powers Of Action. The Agreement Of The Board Of Directors Of Icecyl Dated July 3, 2023, Which Approves Its Organizational Structure, Provides For The Creation Of The General Secretariat, As A Centralizing Body Of A Transversal Nature, Which Will Provide Support Functions And Internal Service To The Entity Itself. The General Secretariat Is Responsible, Among Other Issues, For Articulating All Those Actions Related To The Management Of Its Own Infrastructure, Including Those Internal Regime Matters That Affect Its Daily Operation, Among Which Is The Provision Of Catering Services For Workers And Users Of The Facilities Owned By Icecyl. In The Administrative Services Of Common Uses (Esaum) Located At Príncipe De Vergara Street, Nº 53-71, In Salamanca, Property Of Icecyl, Cafeteria And Dining Room Services Are Provided Both To The Staff Who Provide Their Services In The Building, As Well As To The Administrators Who Come To It To Manage Issues Related To The Powers Of The Territorial Delegation Of The Junta De Castilla Y León In Salamanca. The Icecyl Lacks Its Own Means To Carry Out This Service, Not Having Personnel Specialized In Restoration, So The Outsourcing Of This Service Is Beneficial And Convenient, Which Is Evident For The Purposes Of The Provisions Of Article 116.4 Of Law 9/2017, Of November 8, On Public Sector Contracts (Lcsp). It Is Considered That The Granting Of Services, At The Risk And Fortune Of The Contractor, Is The Most Suitable Solution To Achieve The Objectives Of The Contract And Responds To The Provisions Of The Lcsp. In Accordance With The Provisions Of Article 289.1 Of The Lcsp, The Successful Bidder Will Be Compensated Directly By The Users Of The Services Included In The Object Of The Contract Based On Their Use. Given The Nature Of This Contract, Without A Base Bidding Budget, Budget Processing Does Not Proceed. Due To What Has Been Stated In The Previous Paragraphs, In This Contract There Is No Price Between The Parties Thereof, Nor Is There Any Budget Processing.
