1. The Subject Of The Order Is The Performance Of Construction Works Consisting In The Renovation Of The Fence At The Primary School No. 166 At Ul. Żytnia 40 In Warsaw.2. A Detailed Description Of The Subject Of The Order, The Scope Of Work And The Method And Conditions Of Implementation And Acceptance Of The Subject Of The Order Are Specified In: A) Technical Specification For The Execution And Acceptance Of Construction Works, Constituting Annex No. 10 To The Swz, B) Bill Of Quantities For Information/Auxiliary Purposes, Constituting Annex No. 11 To The Swz, C) Drawing 1 - Diagram Of The Span And Drawing 2 - Location Of The Fence Renovation At Ul. Żytnia 40, Constituting Annex No. 12 To The Swz, D) Draft Provisions Of The Contract - Contract Template, Constituting Annex No. 6 To The Swz.3. In The Proceedings In Question, The Ordering Party Applies The Social Clause Pursuant To Art. 95 Of The Public Procurement Law. The Ordering Party Requires That The Persons Carrying Out The Subject Of The Order And Performing Activities Related To General Construction Works Are Employed By The Contractor Or Subcontractor, On The Basis Of An Employment Relationship, In Accordance With The Act Of June 26, 1974, Labor Code (Journal Of Laws Of 2025, Item 277, As Amended). Detailed Requirements Regarding The Method Of Documenting And Verifying The Employment Of These People As Well As The Ordering Partys Rights To Control This Employment And Sanctions For Failure To Meet These Requirements Are Included In The Contract Template Constituting Annex No. 6 To The Swz.4. Information About The Division/Lack Of Division Of The Order Into Parts. The Ordering Party Divided The Order Related To Construction Works In The Field Of Fencing Into Parts, Each Of Which Is The Subject Of A Separate Procedure. This Proceeding Concerns One Of The Above-Mentioned Parts Of The Order.5. Pursuant To § 3 Section 2 Of The Contract Template, The Contractor Is Obliged To Have A Civil Liability Insurance Policy For The Conducted Business With An Insured Amount Of Not Less Than Pln 400,000,000 (In Words: Four Hundred Thousand Zlotys 00/100), Throughout The Duration Of The Contract, Which Will Cover His Contractual And Tort Liability. 6. The Ordering Party Informs That It Intends To Allocate The Gross Amount Of Pln 400,138.98 To Finance The Contract7. Guarantee. The Contractor Will Provide A Warranty For The Completed Subject Of The Order For A Minimum Period Of 36 Months. The Contractor May Propose Extending The Warranty Period To 60 Months. The Warranty Period Is The Criterion For Evaluating Offers - See Chapter Xiv Of The Tor. 8. The Ordering Party Does Not Require An On-Site Visit.9.
