1. The Subject Of This Order Is To Update The Design Documentation For The Renovation And Adaptation Of Hotel Buildings Into Residential Buildings Located At Ul. Siemianowicka 105A And 105E In Bytom.2. As Part Of The Execution Of The Order, The Contractor Is Obliged To Perform Authors Supervision In Accordance With Art. 20 Section 1 Point 4) Of The Construction Law. The Ordering Party Provides For 15 Supervision Activities.3. The Documentation That Is Updated Has An Active Building Permit.4. The Updated Documentation Will Be Used To Initiate Public Procurement Proceedings For Construction Works.6. A Detailed Description Of The Subject Of The Order Is Attached As Appendix No. To Swz.7. Detailed Terms And Conditions Of The Contract Are Included In The Draft Provisions Of The Contract, Which Constitute Annex No. 2 To The Swz. 8. Due To The Fact That The Activities Performed By Persons During The Execution Of The Contract Do Not Exhaust The Concept Of An Employment Relationship, The Ordering Party Does Not Require The Employment Of Persons On The Basis Of An Employment Relationship. 9. The Order Is Co-Financed Under An Agreement With Bank Gospodarstwa Krajowego - Agreement No. Bsk/24/26/0003859. 10. The Ordering Party In Connection With Art. 441 Section 1 Of The Public Procurement Law Provides For The Option Right To Exercise Authors Supervision. A Detailed Description Of The Options Can Be Found In The Draft Contractual Provisions (Appendix No. 2 To The Swz).11. The Ordering Party Did Not Divide The Procedure Into Parts. Justification For The Lack Of Division Into Lots: The Subject Of The Contract Was Not Divided Into Lots. The Lack Of Dividing The Order Into Parts Is Justified By Technical And Organizational Reasons And Due To The Comprehensive Nature Of The Order. The Ordering Party Did Not Divide The Procedure Into Parts Due To The Fact That The Update Of The Design Documentation Concerns One, Coherent Design Documentation, Which Covers 3 Buildings Located At Ul. Siemianowicka 150A, Ul. Siemianowicka 105B And Ul. Siemianowicka 105E. A Building Permit Has Been Issued And Is Valid For The Documentation In Question. As Part Of This Documentation, Construction Works Have Already Been Carried Out On The Building At Ul. Siemianowicka 105B. The Order Includes Updating One Design Documentation, Functionally And Formally Related To One Building Permit, Therefore Its Division Into Separate Parts Or Conducting Two Separate Proceedings Is Not Justified From The Point Of View Of Correct, Consistent And Responsible Execution Of The Order. Such A Division Could Lead To The Dispersion Of Design Responsibility, The Risk Of Inconsistency Of Design Solutions And Difficulties In Coordinating Documentation Covered By One Construction Permit.
